I received on june 14th but it was returned as in my IMM 5406 Additional Family Information form some of my details were missing and i re-submitted on same day. After resubmitting how much time do they take to view again?
If you had to resubmit the whole application, you start counting from the start. So as mentioned above, it will be another 2-3 months.
In theory a disable person can sponsor a spouse. There is no listed minimum income to sponsor a spouse or partner. BUT the sponsor needs to show that he can support his family/spouse when they move to/live in Canada. So either that person has other source of income (investment) or have savings or have some money from inheritance or have family support (e.g. parents of sponsor providing housing and food ...etc)
So, yes, someone on disability support/assistnace could sponsor his/her spouse. It depends on whatelse other than the disability payment they have so that the spouse will not need social assistance (in that case, the sponsor will need to pay the government back any social assistance given, e.g. if they break up and spouse claim social assistnace)
Note that your spouse can only apply for open work permit after AOR (the application is deem completed with no missing form or document). It will take a few months for both the AOR and the OWP to be approved. At the mean time, you spouse will be in as a visitor and can't work until OWP is approved.
ok thank you for that clarification. I suppose he is allowed to stay legally during that time of we should apply for visitor record after getting married?
I'd add I believe that IRCC would take into account whether the spouse can support themselves (either by working or savings or whatever). Of course, it's also possible that (if the spouse works) that would affect the amount of support the govt provides the disabled sponsor once the spouse lands and begins to work as well (but I don't know about how assistance to disabled works).
But definitely the sponsor should be aware that while there's no formal minimum, they will look carefully into the support question. (They will likely assume, for example, that the sponsor would not be able to repay any social assistance provided to the spouse)
He needs to extend his stay as a visitor before his initial visitor status expires. Applying for spouse sponsorship doesn't give him imply status (he is allow to stay as long as he keeps his status legal via extension etc) . But application of the OWP does give him implied status. So extend his stay and make sure that he continue to have legal status (otherwise, he cannot apply for OWP if he is out of state)

Hello, I applied for spousal sponsorship visa as my wife has PR. I am still waiting for the AOR. Can I apply for tourist visa in the meantime without AOR? I don’t have UCI number as I never applied for any Canadian visas before. Please advise.
Everybody can apply for a visitor visa, with or without being sponsored.
However it looks like the more advanced your PR application is (provided it's in a good standing), the easier it will be to get TRV.
So if you have a strong case for TRV (strong ties to home country, great financial situation etc) you can apply anytime. Standard TRV processing times will apply.
Thank You for the reply Ercan. With the new family reunification public policy, do I still have to show strong ties showing I will go back? Because, as per that new policy, after applying for Outland PR for spouse, they can apply for open work permit when both live in same address. So TRV becomes dual intent. Do you think IRCC is still looking for strong ties for approving TRV?
