Hi there, I'm currently living in Canada using a study permit, my husband is a Canadian citizen, but he's working in the US now. He wants to sponsor me to apply for PR in Canada. I'm wondering if we should apply under the family class or spouse sponsorship class. I do have a list of documents showing the same address currently (e.g. our bank account, our driver's license etc.), and we've been living together for 3 years. He just moved to the US in 2022 October. Based on what's said on the IRCC website, in order to apply under the spouse sponsorship class, 'you must be living together'. Can I take his current state in the US as temporary and apply under the spouse sponsorship class given all those same address documents we have? Or can I only apply under the family class, which I assume will be more complex o apply? Please help! Thanks!

You must apply outland. You cannot apply inland since you are not currenly living together and he's living outside of Canada. Your only option is to apply under family class.

Are you actually studying full-time? If you aren’t you may have lost status in Canada. Your husband will have to provide concrete evidence that he is planning on returning to Canada full-time to sponsor you. For example proof of a job in Canada, proof of the job in the US ending, proof of giving up housing in the US, etc.
