One of my friend has chance to get work permit from her uncle. She is a working professional and her uncle wants to release offer letter for her in order to sponsor her. Is IELTS required for her or not ? If yes then how much band she requires to get each ot overall ?

Is the uncle eligible for a LMIA? She should have employment letters, IELTS and ECA to prove she can do the job. Her uncle’s business would have gone through all the paperwowrk and approval with EDSC proving no Canadian or PR can be hired, only this person has the qualifications to do the job. So her IELTS should match the NOC requirements.

Thank you but i am not clear with the answer. Her uncle possesses PR so eligibility won't have any problem. But Is IELTS mandatory for my friend if she gets work permit ?If it's mandatory how much band score is required?

Being PR is not relevant. His business needs to be eligible. He needs to apply for a LMIA. The LMIA proves that he cannot hire anyone in his business in Canada. So he needs to post the job to Job Bank and other sites and keep track of those who apply. He has to prove that those who apply in Canada don’t have the qualifications (work experience, language and education to the NOC) but only his neice does. The job must meet the median salary for the the NOC. See the link for requirements for the business owner. He pays $1k and then fills out the paperwork. The forms will include market assessments required on his business.

Once he has a positive LMIA for the NOC, the neice apply for a closed work permit. She will need IELTs. This should match the NOC’s requirements. I can’t tell you what the IELTS requirements are because you need to check the NOC database. Her application with LMIA will be more heavily scrutinized because it is a family member.

The fact that he is trying to hire a family member will likely lead to more questioning whether this is truly a job available that someone in Canada can not do or is this is a way to help a family member immigrate. If you could easily hire a family member and get approved for PR or a WP then it would be done all the time.

The IELTS requirement is new to me. My company wanted to do my LMIA too and the legal + HR dept never mentioned IELTS or ECA as necessary documents. I also have friends who are in Canada with LMIA and never gave IELTS or did ECA. Is it really required for LMIA? The LMIA stream was going to be GTS for me (same for my friends too).

I bring up IELTS because some on this forum have been refused due to not showing language proficiency especially in a NOC that is in customer service. Also not sure the uncle understands the LMIA process and OP said the uncle is eligible because he is PR. Nothing to do with LMIA eligibility. Given it is a relative, then the niece needs a very strong profile to show that she is the only one experienced to do the job. This application will be heavily scrutinized.

That makes sense. Thanks for sharing that! :)

I've heard it depends on the NOC or Teer levels / roles and someone told me often entry level jobs have such requirements. I personally didn't have to get IELTS for the WP, mine is Teer0 or managerial and almost 20 years in ICT. However one of my subordinates who was on a Post-Graduate work visa in the USA (I think it is called OPT), transferred here to Canada for an Analyst role and she had to get IELTS for the WP & employers lawyer's forced to get LMIA and didn't allow us to follow the intercompany transfer process. I personally found it weird after having a telephone conversation I felt the attorney was being super cautious and wanted to protect his 100% record of no WP rejections :) .

Do you have an approved LMIA. Offering anything free - food, transportation, air travel, accommodations - then fake.

Did you gave an interview? Did you talk to HR, hiring manager? Did they do a background check?

If none of the above happened, it is a scam.

Yes please,I strongly believe that the IELTS is required, because this test evaluates your English proficiency on a scale of 0 to 9 in each of the four skills, reading, writing, listening and speaking.
Thanks,
Aldophus.
