Hi Guys,

I'm a Canadian PR currently living in India since the Covid-19 Pandemic i.e 2019 - I got married during my stay here and want to apply for Spouse PR and head back. However, I noticed an eligibility requirement stating that 'Person sponsoring can't live outside Canada'

Curious, if there's any other work around to apply with me being in India?

No, you have to be in Canada

Second , when did you get your PR ?
Are you compliant with your RO ?

There is no work-around. You have to be living in Canada to sponsor.

1. No, you have to be in Canada. Careful you may be cutting your PR Residency pretty close if you have been outside Canada for over 2 years.

I have only lived 430 days in Canada after receiving my PR, I have another 365 days to go. Unfortunately, I won't be able to leave my wife and go.

What do you guys suggest? Perhaps I wait it out and re-apply fresh in the express entry pool after the expiration?

If you think you qualify to re-apply via express entry, then you do not have to wait. You can renounce your PR and apply.

There is no workaround to apply to sponsor your spouse and child. You need to live in Canada (may be travel back to visit) and you can't really apply if you do not meet your RO which means that you have to stay in Canada apart from them unless they can both get TRV. (and even if they get TRV and travel to Canada, they will be staying as visitor while you try to meet your RO before you can apply to sponsor them)

If you cannot stay apart with your spouse and child, I think re-applying may be the best way.

One last question, curious if renouncing my PR - would that have any negative repercussion, when I re-apply?

No negative repercussions but be very sure you can get another invitation or be okay with not immigrating to Canada. There have been no FSW draws in a year so you need to have a high CRS score or be eligible for a PNP program with a high demand NOC.

During your first five years, the easiest test is whether or not you have been out of Canada more than 1095 days (from the day of landing)*. Dates as provided by you - not enough information to be certain, but if you have 430 days in Canada then you PROBABLY are still in compliance.

If you are still in compliance, I would look carefully at the choice between renouncing PR status / starting over (uncertain and might take some time) or returning to Canada soonest and applying to sponsor your spouse.

With the latter option, you may be apart some period of time (sponsrship usually less than one year and TRV for spouse and child not out of the question) BUT have a high degree of certainty.

If you renounce, even though renouncing will not harm your future app, there is no guarantee you will be selected again.

Only your choice though.




*This is just arithmetic restatement of the rule that you must be in Canada 730 days in five years (but they give you credit for future days to the five year anniversary), i.e. min 730 days in Canada of five years = no more than 1095 days out of Canada.

Nothing negative for renouncing.

But keep in mind there have been no Express Entry / FSW draws since December 2020 and we don't know when they will restart. Scores will certain be high when draws restart. You'll want to make sure you have a score of 480+ to have a decent chance of being selected. Would check your score before renouncing.
