I got married this year legally in Mumbai, India for the immigration purpose however it has not been mentioned in any document. Another thing which I have to mention is that I am Muslim so until and unless I cannot get my nikah I cannot even consider this as a marriage.
However now me and my legal spouse are having a break up and as per Indian Law you cannot get divorced within a year. So I would like to know if you can apply as a single applicant and will their be any possibility of cic to find this as there are no records in professional docs neither in personal nor in passport.

Another option I can think of is I can re-marry to some other girl get my Nikah done with proper legal marriage, then do I have to show my previous marriage records ( As I am still waiting to send my EOI)

Experts please advice.

CIC considers legal marriage above every other cultural weddings.

You cannot apply as a single. It will be misrepresentation of facts. You could be banned for 5 years.

You can apply as legally seperated.

So, you intend to lie about your "legally" married status to IRCC? If you are "legally married" in India, such that you require a divorce, assume that IRCC can, and will, discover this. I should also point out that when they do, it's an almost automatic ban for 5 years for misrepresentation.

If you have marriage certificate then I would really suggest you to mentioned it in your file, don't hide anything
If any agent is imposing this idea about apply as single then don't listen to them
Just be clear and before moving to next big thing, please try to clear all your backs nicely

If you're not legally divorced yet, you cannot get remarried. I think being married to 2 people at once would definitely be of concern for CIC.

IRCC will consider the second marriage as void. Bigamy is also illegal in Canada.

My friend was getting more points as single applicant compared to points as married. So he made a express entry profile as single applicant coming to Canada but showed that he is married. He has subsequently recieved ITA and AOR under express entry.

He did give a LOE stating the same reason as he has more points as single applicant and would wish to bring his wife later once if gets his PR. No problems so far. He recieved AOR in may 2016.

If he showed that he is married, then he didn't apply as a single applicant; he applied as a married applicant with spouse non-accompanying.
This is a perfectly acceptable thing to do.

What OP is thinking about doing is lying about his marital status, which is misrepresentation.
