WP is refused. Want to stay in Canada - Urgent

Condition
WP extension is refused because LMO is not valid (its in process). Now I have 90days of restoration period to stay.

Wife is working in Canada with a separate WP from her company. We have a son born in Canada, who is going through some medical treatment and doctor has asked us to complete treatment before leaving Canada.


Option to stay in Canada
1) Ensure LMO is approved and apply for restoration with new LMO.
2) Apply Restoration as depandant to spouse as visitor or open WP. I am fine to stay without work also but need to be with my son.

Want to know if option2 is feasible ao apply inside Canada? OR I need to go out and apply, which i dont want?

If your wife's WP is closed and under skilled WP, then you can apply for an OWP. Send the restoration and OWP application. Attach a copy of her WP.

i think job code 2174 falls under skill category A. What does she do? I had my wife with me almost the same situation. However, we aplied paper for the first time and got OWP in almost 90 days but that was in 2010. I extend her work pemit again last january but this time we went to the border. Based on your situation, if your wife's work permi falls under skill category, try driving to the border, just get the flag pole from US immigatrion and apply in the canadian border service. If you are lucky enough you might get OWP right there. If not just send the the paper aplication. Good luck

I heard that I can do it in some CIC office in Toronto. Anyone have an Idea? In which office in Toronto, I can file my restoration and Spousal OWP.

Apply for the restoration and the OWP. Attach a copy of your wife's WP. She's on skilled WP. You can't do it online because you have to have a valid status to be able to apply online.

Job_seeker is correct. you should apply for restoration and OWP at the same time, Attach the copy of your wife;s work permit, pay stubs for her, her contract letter etc. It shouldn't take long time. Do it right away before your 90 days of restoration period expires.
