Hi,

Please advise, if we need PCC for applying closed- work permit at the border through flag-poling.

The documents I will be carrying is
1. Passport with Valid TRV,
2. Medical Report
3. LMIA Approval,
4. Job Offer letter separate on company's letter pad.

if anything is missing, please advise.

Is this your first WP? If so, you don’t qualify for flagpoling. You must apply online.

If this is for your father who is here on a supervisa he can only apply for a WP online.

Yes It is the first work permit, Thank you for your advise.
Can he work before his decision ?
No he can not work until he has a WP. He should expect that it will take around 6 months to get an approval or refusal. If your brother got a TRV he is not entitled to attend public school. He will need a study permit and to pay international student fees. If your father is approved for a WP and his job is in NOC 0, A or B then your brother can apply for a study permit and if approved can attend public school in Canada and not have to pay international fees.

He can’t flagpole nor work until WP approved unless from TRV exempt country.

Regulation 198: This, in part, states that:

  • Residents of the USA, or St. Pierre, & Miquelon, may re-enter Canada after a visit to these three places without requiring a temporary resident visa or TRV. And they can apply for a work or study permit at the Point of Entry (POE) – in other words, the border crossing where they re-enter Canada. However, this exemption is also available to:
    • Residents of TRV-exempt countries whose jobs are LMIA-exempt;
    • Residents of TRV-exempt countries who have a positive LMIA.
  • In other words, if you are a foreign national from a country for which Canada does notrequire a Temporary Resident Visa, then you can apply for a work permit while re-entering Canada after a visit to the USA or St. Pierre & Miquelon.
  • You can also have your PR status and/or PR visa validated if you are a temporary resident who has just been notified of your new PR status and how wants to avoid the wait for an appointment at a local IRCC office.
Regulation 190: This states that a foreign national (in other words, someone from a non visa-exempt country) is exempt from the requirement to obtain a temporary resident visa if they are seeking to enter and remain in Canada:

  • After a visit to the USA, or St. Pierre & Miquelon AND IF THEY
  • Hold a study or work permit issued to them before they left Canada on such a visit, or were authorized to enter and remain in Canada as a temporary resident or to validate their new PR Status and/or visa, AND
  • Return to Canada before the end of the period initially authorized for their stay or any extension of it.
