HI, I have a question

My PGWP expired on 5th april, so I applied for open work permit on 2nd April, today I got refusal letter from CIC saying that your application is refused and also written that "We also wish to advise you that your temporary resident status expired on June 29, 2020.". So just wanted to know if the work i did from 5th April till 29th June can be considered towards my PR?

and I am leaving the country in few days so is it OK if I stay in the country till then without applying for restoration

Thanks

Yes you have 90 days to apply visitor visa my advise is get the visitor visa then look for a employer with in that period who can support you to get the LMIA

If your PGWP expired on April 5th, then any work experience from April 6th forward cannot be counted towards PR since it will be classified as work experience gained without authorization.

Hi Scylla, Thanks for your comment but I am still confused

My refusal states something like this

"
Based on your application and accompanying documentation that you have provided, I have
carefully considered all information and I am not satisfied that you meet the requirements of the
Immigration and Refugee Protection Act and Regulations. Your application as requested is
therefore refused.

[X] We also wish to advise you that your temporary resident status expired on June 29, 2020."

And my Work permit expired on 5th April 2020.

and based on the information given on the CIC website

  • If the extension is refused, the applicant is considered in status until the day the decision is made on their application.
  • If the extension is rejected (incomplete), the applicant is considered in status until the temporary resident document expires

and my application is refused not rejected so based on this I can say that I was on status till 29th June and work I have done till 29th June is considered as Authorized work?

Correct me if I am wrong?

You're fine, you can stay here to apply for restoration in a few days and you must not leave Canada while you're restoring your status. I'm in the same situation.

Hi Scylla, Any thoughts on this?

It probably states in your refusal letter that:

"You may apply for restoration if, within 90 days from the expiry of your temporary resident
status, you submit:
 a completed application form;
 applicable fees for restoration and for the immigration document(s). Payments should
be made online at www.cic.gc.ca. When you are finished, you must print the receipt of
payment and include it with your application.
 all required documents in support of your applic ation."

Hence you can apply for Restoration but you can't leave while it's in process of restoration, and and you can't work either. That's all you need to do I'm pretty sure.

Thanks for your valuable comments but my question was regarding the work experience I gained on my Implied status, Can I count the work experience I gained on Implied status on my PR application under Canadian experience class
