Hi Everyone

I am in the very tough situation here. Hope I can get some advices.

My wife and I submitted spouse sponsorship application 50 days ago, along with work permit extension. We have been together for over 8 years. My wife is PR and my work permit expired on Sep 28th. Unfortunately, the package got returned today due to a missing signature. And my work permit is currently expired. That means I lost my implied status. If I go for restoration of status, I won't be able to work until I get the new work permit. ( I worked so hard to get this position in last few years, I don't want to lose it). If I just fixed the signature and re-send the application as it. Write the letter of explanation . Is there any chances the office will give an exception on the case? Or any alternatives I can try?

No. If an application is returned as "incomplete", it's treated as if it was never submitted. There will have been no processing performed on it. If you are already out of status, you must stop working and apply for restoration. You have actually been working illegally since your work permit expired, as no implied status ever existed for an unprocessed application.

No, they will not make an exception. You can re-submit the PR app and apply for Restoration as a worker on the OWP app. Some have been successful in getting the OWP in the normal 4 months by doing that, while others have been refused the OWP until AIP, which is near the end of the process.

Note that regardless of what you apply for, you must immediately stop working. It will be at least several months before you are once again able to work.
 
Unfortunately I haven't seen any examples on this forum where IRCC has made an exception. As others have said, if the application is returned as incomplete, it's as if you never sent it. I would apply to restore your status asap to get this process going and also resubmit the inland application along with the OWP. You will unfortunately have to stop working immediately. I don't see any alternatives or options that would allow you to keep working. You'll have to wait until the OWP is approved before you can start again.

I read this one , and just wondering if i can do the same thing. I will resend the inland application . At the same time If I submit a visitor visa application online ( processing time 5 days) and submit a SOWP application online (processing time 66+) will it make faster for me to get new work permit?

An SOWP is something different, for spouses of international students and foreign workers. You cannot apply online without lying and saying you have AIP; when IRCC starts processing the app and realizes you don't have AIP, it would be refused.
 

The processing times for Restoration apps are not set. Some people are approved faster, some take months. OWP apps generally take around 4 months but some, like that person's, are processed faster.

You can apply for Restoration as a visitor, wait for approval and then submit the OWP app. Or apply directly for Restoration as a worker. No one can say what will be faster. Either way, it will be months before you can work.
