Work permit at the border port-of entry

Hi everyone

I am having problems finding the right info and I am close to pulling my hair out!! Basically, both me and my partner have been living in the UK for seven years, he is portugeuse(therefor part of the EU and does not need a visa to enter Canada) and I am south African, but am currently living in the UK as his partner (common law partner). He got a job in Canada and it has already gone thought the whole LMO proccess and been approved, and they told him because he is a EU national, he can get his work permit at the port of entry( airport), but I need to travel with him and I need a visa, I know that I am ellegible for a open work visa as he is highly skilled, but can I apply for this at the port of entry with him? Or should I get a tourist visa and then apply once I am in the country? Please help....I am sooooo confused!

No, you can not apply for it at the border. You have to submit the application at a Canadian visa office in the UK, who will issue a temporary resident visa that allows you to travel to Canada. When you get to the port of entry in Canada, your open work permit will be issued.

Thank you so much for this information, I have also spoken to a immigration layer this morning, and she advised me to get a tourist visa to get to Canada, and once I am there I can then apply for the open work permit.

Hi,

I am from a TRV exempt country and planning to get WP at port of entry in Canada. Recently my US H1 visa was denied with reason 214b (no strong ties to home country). I have the below queries:

1. Does this US H1 denial impact my entry into Canada at the port? Do I need to prove my ties to home country at the port? How?
2. At the time of port of entry, I would have resigned my job at home country, then how can I show job as a tie?
3. Documents required at port of entry? Do they give multiple entry visa at the port for the duration of my LMO?
4. Can my spouse also get an Open Work Permit at the port of entry?

1. I don't know if it will impact your entry to Canada, but the refusal should be disclosed when you fill out the forms. Not sure how you can prove ties to home country.

2. No idea

3. LMO, valid passport, job offer, your CV/Resume, proof that you meet job qualifications e.g. licence, degree, certificates, etc. As you are TRV-exempt, you will only receive a work permit valid for the length of your LMO.

4. If your job is skilled(falls under NOC O, A or B) and your wife is also from a TRV-exempt country, she can apply for a spousal open work permit at the border.

hello i have a question if you will apply a work permit online do they need to give our original passport? coz my passport will expire next yr just asking if i can apply work permit at the same time i will renew my passport thanks

I have several questions regarding applying for a work permit on-line

1. my LMO will expire on November 14, 2012(3rd week) and I plan to submit my online application on the 1st week of November because I still have to wait for 10 days before the medical clearance to be sent to ottawa.. Should i wait for that 10 days before applying or the receipt of my medical is enough?

2. The processing of online work permit is more than 30 days, so am sure my LMO will be expired within that 30+ days. Should i just apply outside canada (eg. L.A.) in person to make sure the processing is faster, or as long as I submitted my papers online while my LMO is still valid...its ok?

I hope anyone can enlighten me in this situation....

Send your application together with the LMO before the expiry of your LMO, else you'll be waiting for a new LMO and it's longer than waiting for the WP :( Are you in Canada as a worker?

I’m in Canada right now on temporary resident visa. Are you saying that it’s ok as long as I submitted my application on-line before my LMO expired?

1. Instead of waiting for medicals to be sent to Ottawa before you apply, include a copy of the medical receipt(the one with maple leaf) with your application and apply right away. What if the physician takes longer to send it, will you continue waiting?

2. The work permit application must be submitted BEFORE the LMO expires. After that, it doesn't matter how long processing takes. Be sure to include every document on the checklist.

I have several questions and hopefully you could help me with my situation:

My employer didn't renew my contract and the work permit is valid until Nov24.
I applied in two companies so it would be safe for me to get an LMO right away.
Company A got me an LMO today and asking me to file the Work permit ASAP since his LMO will
Expire on Oct28. At the same time that I applied in Company A, I also applied to company B
I really to work in Company B since i know his a good employer but he's asking me to wait but I know
He's willing to process me an LMO since he will open a new store.

Here's my question:

1. If I apply for a Work permit for Company A and at the same time while my permit is on process,
Company B asked me to go to the Border and get the work permit. Is it legal for that case that While I have
An existing application online, i'm also applying in the border?

2. Will the Immigration allow such thing? Applying for two different companies simultaneously and once i get my work permit in the border, i'll just cancel my online application & proceed to Company B?

If I were you, I would apply for the work permit using the LMO from company A. There is no guarantee company B will be able to obtain a LMO for you... Service Canada makes the decision.

1. If company B gets a LMO for you, you may go to the border to apply for a work permit. If you are not from a visa-exempt country, the border officer has discretion whether or not to process the application. If you obtain a permit there, you may withdraw the online application. Note that if processing has already begun, the application fee will not be refunded.

2. You may have simultaneous applications, but will have to withdraw one of them.

Company B just call a while ago and assured me that LMO is already in Service Canada.
Would you know what common question an officer will be asking if ever? I think I'm decided not to
pursue Company A. So it won't be risky having 2 work permits at the same time. Hope and praying it's a good decision.
