Work permit and New Employer / Unauthorized work? Please HELP!

Hi everyone and thank you for your posts,

I have a situation where my open work permit expired and I got new CLOSED work permit with my current employer for 3 years.

I've been recently laid off from work and I found new job but they do not want to wait for me 5-6 months to get new work permit and all that...they need someone to start right away!

My question is what is going to happen to me/them if I give them my SIN and do not show them my Work Permit? They did not ask me for work permit they just want my SIN, which I have of course and it is valid for next three years. How can government or CIC or immigration find out that i am working with another employer?

Please can someone explain me what are the consequences of doing that but please just do not tell me it is illegal and I need to get new lmo and new wp... I know that!

Every employer need give new workpermit but u can be done the processed by the owner around 45 days but u can start work with them for sure

I can't be done in 45 days, I am pretty sure... it takes 2 months for LMO and almost 3 months to get new work permit. I think you didn't understand what I mean, I do not want to apply for new LMO and new work permit... I want to use my closed work permit and work with my new employer without applying for new work permit...

What can happen to my new employer/me?

1. If your employer hires you illegally by not obtaining an LMO and ensuring that you have a valid work permit, then they could be blacklisted by CIC and investigated/prosecuted by CBSA.

2. If you work without a valid LMO and work permit, you will be committing an offense and could be deported.

3. In the current climate of negative media attention regarding the TFWP, do you and the employer really want to take the chance that none of the Canadians/PRs on staff will file a report with CIC, CBSA or the media?

You can flagpole and change the employer in the closed work permit , that will save time as online/paper application can take a considerable amount of time.
You do not require a LMO as you already hold the closed work permit. It is not good to hide information instead get your work permit changed to reflect the new employer.

That's simply not true. He will need a new LMO from the new employee to get a new work permit.

My friend had her work permit changed at the border so yes it is true. She was on a closed work permit after having her open work permit expired & being PNP approved so if the OP had a similar route to the closed work permit, the information is valid.

If on the otherhand, he was on TFW program with an LMO then the OP should take the same route for the change in employer.

From the original post I did not see an indication if it is the latter hence may be wrong with the assumption made

A closed work permit is tied to that employer only. It can only be given with a LMO. Each employer must have a valid LMO for their company, job, and the employee they want to hire. They cannot use another company's LMO.

A TFW cannot get a new closed work permit without a new LMO except in every few circumstances (like NAFTA, member of the clergy, etc).

Hi guys, thank you for your posts! Ok, I got it! I need new LMO and new work permit if I want to change my employer.

My question is what is going to happen if i do not do that? If I just go to the new company, give them my SIN, start working and do not do anything regarding my LMO and new work permit? They didn't ask me about my work permit and what's my status...

How can immigration know that I changed my employer?

I found 3 jobs so far! In the first 2 jobs after getting a job offer I told HR manager I will need LMO and WP, and of course they said we can't wait for you. It takes freaking 6 months so I understand them!...So I lost 2 opportunities!
I need to make money somehow, I do not want to lose another opportunity just because there is some people with PR who are not capable of finding a job!

I'm not sure if that is the right attitude. The people with PR have a right to be here, and you don't.

Excuse me? I have valid work permit, I went to school here... I am not here illegally man... I just want to work because I've been laid off... What's wrong with that man, tell me?

In the worst case scenario I will get my employment insurance. I wanted to avoid that since I found 3 jobs already... but sure I'll get it and sit at home until I get my PR.

Don't you see that LMO/new WP thing doesn't work? We are talking about business world here, I am telling you, companies won't wait for you 6 months! That is ridiculous!

Ummm...you had a work permit for a specific job, which you are not at anymore. So what is your status exactly?

What's ridiculous is the sense of entitlement that TFW's seem to have. The LMO system was designed to ensure that Canadian citizens and PR's have the opportunity to fill a job in Canada, and only if a suitable Canadian citizen/PR is not found does a foreigner get the chance to come in. Companies do not have to wait 6 months, as I'm sure they can find a Canadian to hire instead (as one of the companies who provided you an offer with indicated).

What doesn't work is this faulty LMO system that is being abused to bring in people for unskilled jobs and as a "back door" for PR status.

My status is I have closed work permit till 2015, but unfortunately I've been laid off from that job... So I am not illegally here. I can stay in Canada till my close WP expires.
I applied for PR under CEC and I expect I will get it in 9-10 months.

If they can find Canadian citizen to fill that position how can I find a job and change the employer? Then you confirmed that LMO is big bs...I am screwed then... I should pack my stuff and go back to Europe until I get PR, is that what you are saying?

I am sorry but I don't get that LMO thing... My employer posted a job, interviewed more than 10 candidates and I was the strongest suitable candidate for that job. (Marketing Manager position)
For me the story is done here... I would understand that whole process if I can start working for that company right away and if LMO is negative for some reason, they will have to sack me from work. That would be more fair to me and I think makes more sense.
But no, they have to apply for LMO (almost 3 months in TO.) and then I have to apply for new WP ( also 3 months) and I am not supposed to start working till i get my new WP.

This is killing me... It is so wrong, it hurts! I don't want to get IE but I have to. I am going to sit at home and get your tax money...

And I don't even want to bring the topic about who's getting PR and how!? It is so many wrong things in this system...

Because it says on your CWP it's valid for that employer only. Only the employer that gave you the LMO had permission from HRSDC to hire a foreign worker. The employer has to prove it's tried to find a Canadian citizen or PR for the job already.

You want to start informing employers up front your start time includes the time to process a LMO and a WP or look for jobs that begin several months out.
