Withdraw from Private Sponsorship and going through Canada-USA border

Hi

I and my family applied for refugee outside canada (private Sponsorship) in Dec 2016 and till now no response or interview and it says Application received in our online application status till now.

So now we decided that either all or some of us will withdraw from this application and try another way like Canada-USA border since we have limited time in the country we are staying and cant wait more for the interview to come.

Please does anyone know how long the withdraw process takes AND can one of the applicant withdraw and will it affect.

Please advice !!

You are probably risking having any future claims for refugee protection rejected if you withdraw and try and enter via the border.

Your refugee claim may not be eligible to be referred to the IRB if you:

  • have been recognized as a Convention refugee by another country that you can return to.
  • have already been granted protected person status in Canada.
  • arrived via the Canada-United States border.
  • are not admissible to Canada on security grounds, or because of criminal activity or human rights violations.
  • made a previous refugee claim that was not found eligible.
  • made a previous refugee claim that was rejected by the IRB.
  • abandoned or withdrew a previous refugee claim.

Inside Canada or anywherw in the world under UNHCR if refugee claimed was denied. Any chances to get private sponsorship?

Don't think you should partially withdraw your application. Not that simple. Also individuals sponsoring you have prepared and requested a certain family size. They may decide to go with another family if you reduce the number of applicants. Do you currently have US visas? Your Canadian refugee applications may have flagged your visas. If some of your family members are able to cross the illegal border it will be be around 2 years or more until the hearing and at least 3 years until you get PR and can reunite with the rest of your family. Your family would have to spend around 5 years in a country waiting for family reunification. That would only include spouses and children under 22. Some private sponsorship involve grandparents and some older children who are not married and may have been under 22 when they applied.

Do you know who is sponsoring you? Any change in your file can create delays or problems. Private sponsorships can often include family members who would not be included if you apply for family reunification (e.g. Grandparents, older children, etc.). If you claim asylum in Canada it may take approximately 5 years to get family reunification which only includes spouses and children under 22. Nobody can guarantee that your private sponsorship won't be cancelled if part of the group withdraws.

Do you have valid visas to enter Canada or the US? Are you sure they are still valid given that your refugee application has been received by Canada? US and Canada share information. You seem to be relatively close to the end of the private sponsorship process. You will also be provided with much more help through a private sponsorship.

Nobody can say what will happen because this is a rare problem but you can't guarantee what will happen with the rest of the family who stays behind and what will happen with their private sponsorship. No guarantees that is won't be cancelled, delayed, etc.
