Will my Express be Rejected ?

Dear Friends

I came on work permit (intra company transfer)to Canada in early 2014 along with my wife. We didnt have any children.In Oct of 2014 she returned back to India as we decided to stay separate, we have been separated since then.

My employer had hired a lawyer to process my express entry, invitation received application submitted in August. ince we were living seperately for three years already,my lawyer decided to file as single.

Recently my lawyer has informed me that CIC has asked for a seperation agreement/divorce document.My divorce process is yet to start in India , we have been discussing mutual divorce financial terms. My ex is not cooperating and the deadline given by CIC is end on November.I have made financial proposals to my ex for a mutual divorce but she has unreasonable high expectations.

My question to experienced members here is if I am not able to get the document to CIC what happens to my PR.
I still have a year more in my Work permit, so I can live and work in Canada. But can I reapply for PR again or the same file will be reopened when I get the document in future.

Firstly you can get extension to submit the docs.
Secondly if you both dont agree on terms then your divorce may take years.....
If she want she can drag it for many years, now that she knows you badly need it. you dont really have a choice but to accept to her terms.

You can revoke your application and apply again anytime you want.

If you dont provide the document in time you app will be rejected. It wont cause any problems next time you apply.
May cuase some delays, cant say for sure.

I have requested my lawyer to get an extension, he wasn't very hopeful, but lets see.

I have one more year left in my WP so thats what I have in hand if I have to reapply.

On the divorce timeline, there is one option to apply for Divorce in Ontario

1.The laws are less favourable for women who don't want to work and claim lifelong support from ex husband, compared to Indian divorce laws.
2. After one year of seperation , the divorce process in Ontario is simpler and faster since children are not involved.

Instead of giving her the bargaining power in mutual divorce discussion(because of my PR situation and her comfort in Indian legal system) I will probably file divorce petition in Ontario court.

You can reapply anytime you want.

Also you cannot apply for divorce outside India, if your wife doesnt want to.
If you are married in Canada then you stand a chance, still it will be difficult since you both are indian citizens.
