I don't think you understand, there is no such thing as a "5 year period". The time to meet RO is the previous 5 years from whatever day it is today. So for example if you applied for a PR TD in Oct 2016, CIC would check your RO going from Oct 2011 - Oct 2016. It's always 5 years from any date. It doesn't go for 5 years, and then reset back to zero for next 5 years.

With your family medical condition you could try to apply for PR TD on H&C grounds, and submit all proofs of his condition (doctor notes, hospital stays, etc). It's up to CIC whether to grant you the PR TD on H&C grounds or not. If they reject it, you'll be given chance to appeal. If appeal is also rejected your PR status will be revoked.

If you have a wife in Canada that meets the RO, she can always sponsor you again as spouse under family class if your PR is revoked.

I think you can send in an explanation with the application. I really don't know too much about this. Hopefully someone will reply who has more knowledge

Yes, Rob_TO. I have a husband whose PR card was renewed and did not go under SR last year because we all became Pr at the same time aka in june 2010. He is in Canada so if pr status is revoked. What is the next process of sponsring Nd how long does that take ?

Lets say if my pr status is revoked. Now what can I do ? I can either appeal on H&C for an appeal for my Pr status ?? Or My husband can sponsor me and will the sponspring get me PR CARD ?

Yes I already mentioned, if your husband meets the RO then he can sponsor you for PR under family class if your current PR is revoked. In case a PR TD is denied, this is probably a better option vs an appeal since I've heard appeals can take several years to hear and even then it's a good chance to be rejected.

Time for a family class application will depend on visa office used.

If I apply for PR TD, should I include proof of my brother's illness, medical records and a letter including in all my reasons such as job and my children abroad ? or should I apply normally without this whole proof and wait for it to be possible rejected and then appeal for my pr td ??? or what should I do ?

Submit everything you have for H&C claim with your PR TD application.

Thank you Rob for replying. I will surely keep that in my mind. Is there any chance IRCC may send the pr card to my canadian address in the next few months ? Have you heard of such thing? Or thr opposite of it, has there been cases where IRCC sends a recjection letter for pr card that it has been revoked instead of sending the csrd itself. Can you please answer this ???

If someone cuts the RO say 720 days out of 5 years. Will they Lose their PR status for sure? I am assuming they can appeal on H*C grounds but other than that, what would cic state ? Would they send a letter that pr status is rejected and the person may appeal or is there any other process to this ? What will CIC do ? and if the person is out of country.

First and foremost, the Second issue of the PR Card has to be picked up at the IRCC Card pick up center and in PERSON.
As you say in your previous post, your family and children are here in Canada. So, it is cruel to separate you from them. You also say that you did have 730 days in the first FIVE Years, when you mailed your renewal application. So, prepare to prove with all of the rental documents, utility bills, such as Hydro or cable company or phone and other utilities and that will satisfy their requirements for the 730 days that you stayed here in Canada. Plus an Employment letter and the proof of paying the Income Tax and your Bank Statements should prove your deposit and the pay stubs will give them sufficient material to convince that you did live here in Canada for the 730 days. (I am providing all of these avenues and it is left to you to prove)

You say that your Brother's illness called you away suddenly to your native place. Substantiate the same with phone calls and Medical documents to prove that and include the same with your PR TD application to get back. They cannot refuse the RE-ENTRY now with all of the proofs you have on Humanitarian and Compassionate grounds, plus your 730 days etc., and your Family still living here in Canada.

Please don't forget that Refusing a PR TD at this stage become extremely difficult, as it becomes a refusal of PR, which they cannot do. That process is a long and drawn out process and they will not enter into it. So, that is a Plus for you.

SO, Please APPLY for a PR- TD and you should get it in due course.
