Weird fraud situation aside, this.

@Asmau, if your husband's PR application is already being processed and you guys are actually married, he MUST add you to his application before he lands. If he lands without declaring you as a spouse, you will forever be excluded from family class and he will never be able to sponsor you.

You cannot wait for him to first get his PR and then start your process if you're already married. He has to declare his status as married and declare you as his spouse on his current PR application.

Has your legal husband declared you as his spouse in his PR application? Cos if not, that’s going to be a bigger problem for you if he lands and you are not included. You might never set foot in Canada or USA.

Were you really (legally) married? Or did you lie about being married?

Are you a Canadian citizen or Canadian PR?
To USA, I lied I was married to man A for example. But Now I’m legally married to man B, and we want to start applying for spousal sponsorship, do I need divorce papers?

Well...he hasn’t landed yet, that’s why I’m trying to mail some documents to him so that he can update his pr and include me a spouse. We met through his mom in May. We started talking on social media, voice and video calls mails, etc in July. Then he came to Nigeria in August, we did introduction and got some marriage certificate and all in September. The traditional wedding wedding would be August next year, but we can’t wait until next year when we’ll be able to provide wedding pictures before we begin our sponsorship process, since we have other documents now. What are our chances, what’s your best advice for us? Wouldn’t CIC thinks that the relationship is rather too early for all of these? What other documents can we add to support this

Court declaration of marriage
Affidavit as to change of name
Newspapers publications
I’m planning to have my international passport changed to his surname by next week
We have pictures taken together when he was around and a lot of screenshots of FaceTime, social media post and mails too.

How did you get "legal documents" if you aren't legally married to man A? If you got legal documents to show that you are married to man A then you are legally married to man A. If that is the case, then according to CIC you cannot be legally married to man B. You cannot be legally married to 2 people at the same time.

Yes, you will need divorce papers from the court where you and man A are divorced. Then you will need a valid marriage certificate from AFTER the date of your divorce. You cannot legally be married to both at the same time - so, if you divorce on say 1 November 2018 but you got married to man B on 1 September 2018 your marriage to man B is not valid in the eyes of CIC because you have committed bigamy. (Not to mention the fraud).

You're going to have issues one way or another. You have to declare the US visa denial, and CIC will likely ask the US why the visa was denied. You may then have your file transferred to the CIC including the marriage information that you lied about. So yeah, you may wish divorce papers.

And yes, the CIC will perceive your relationship as a risky one because it's so fast and primarily online.

When IRCC detects the original marriage is a fake (via USA) and that the supplied divorce papers are also FAKE (via the PR application), they will
1) Ban the OP for 5 years for misrepresentation and
2) Probably cancel the husband's (Man B) PR application, as the spouse of an inadmissible family member.

And that's why 1) applications from there are heavily scrutinized and 2) the OP's deception will be discovered, because of 1).

There is HUGE difference in the amount and depth of the background and security checks between a visitor visa and a PR application. That's probably why the USA didn't pick it up, whereas Canada will.
