Why they reject Nursing instructor working in health college

Dears;
I applied under skilled worker as (Nursing Instructor) but thy reject my application as ther i no Job offer attached to my application, the mentioned that my occupation not in minister 38 occupations list, but befor I applied I checked (Nursing Instructor) is mentioned under: College and other Vocational Instructor(NOC 4131) in Human Resources and Skilled Development Canada website:

You must have received a letter from the CIC to this effect. Can you write the contents of the letter here? It will help a lot of the members to help u. You are not obliged to do this though.

Thank you BobbyB, yes I received a letter from CIC, it says:
Prior to February 27, 2008, an application was eligible for processing in the Skilled Worker Class if the applicant had at least one year of experience in any occupation listed in Skill Type 0, or Skill Level A or B of the National Occupational Classification (NOC). Changes were made to the Immigration and Refugee Protection Act which affect applications submitted on or after February 27, 2008. Your application was received on or after this date and is subject to these amendments.

The Minister of Citizenship, Immigration, and Multiculturalism has issued instructions which specify that only applicants who have an Arranged Employment Offer, who are currently and legally residing in Canada and have been for at least one year as a Temporary Foreign Worker or an International Student, or who have work experience in 38 specific occupations are eligible to be processed in the Federal Skilled Worker class at this time. These 38 occupations are identified by codes and described in the National Occupational Classification (NOC). You may access the list of eligible occupations on our website at:

I suppose that you applied under 4131 but your duties didn't correspond to those listed under 4131. i am purely guessing. You should look at the duties and see what you do in your own work. Then describe those duties in your application clearly. Only apply if you do most of the duties listed under 4131 as well as the duties described by the lead statement.

Thank you very much, but the CIC letter saying(The occupation you indicated on your application do not correspond to any of the 38 specified occupations therefore your application is not eligible for further processing) saying the occupation I indicate not duties.
can you give me the main duties for nursing instroctor as per canadian national occupation classifications.

Personally, I think your NOC is the Problem. This seems not to be on the Ministerial List.

Note: While the Regulations clearly place responsibility on applicants to undertake research of the NOC
and provide the NOC coding for the occupations in which they claim qualifying experience,
officers
are expected to exercise discretion where applicants may have made minor errors or omissions in
correlating work experience and NOC coding.


• not take into account whether the applicant meets the “Employment requirements”
description set forth in the NOC for the occupation(s) listed;

award points only if the applicant has performed the actions described in the lead statement
of the particular NOC description and has performed at least a substantial number of the
duties described in the “Main Duties” summary – including all the essential duties
(R80(3));

Note: Neither the NOC nor the Regulations distinguish between “essential” and “non-essential” duties or
provide guidance as to what constitutes a “substantial number”. This is left as a matter for
assessment on a case-by-case basis. If officers have concerns about whether or not the applicant has
carried out “a substantial number of the main duties…including all of the essential duties,” they should
give the applicant an opportunity to respond to these concerns.

• take into account any years of experience that occur between application and assessment,
and for which the applicant has submitted the necessary documentation (R77).

Since 4131 is in the ministerial list, i can see one of the following having happened:
1) 4131 was either hard to read or misread by the officer,
2) You were rejected based on the main duties, which is still equivalent to being rejected on not corresponding to the one of the 38 jobs,
3) THey might have one standard letter for everyone who gets rejected on the wrong NOC code or for reasons of main duties.

i believe there is no main duties of nursing instructor per se but the main duties of 4131 which is common to most vocational instructors.

Hello, i applied under FSW using nurse instructor with NOC 4131. But i received a postive reply from NS. I just wrote the duties of the nurse instructor as i knew it since that is really what i do. There must be something wrong somewhere in your application you might have missed out something or they might have misread something also.

4131 IS on the list. So if you have indicated the right number and the duties correspond to those descibed on NOC website for 4131, then it must be a mistake by the CIC. To err is Human!
But if you failed to clearly indicate your duties and NOC code, then they must have made the decision based on your input.
I would apply again.

The problem was that since you are a nursing instructor you gave your functions accordingly

I did not see nursing instructor in this...(may be I missed it). I think that that you wrote 4131 so obviously they compared your duties with their standard of functions for the category 4131. but it did not match..... I think that nursing instructor falls in another category....check out with somebody else....


I think you should have mentioned 3151 instead which is also in 38 occupations list.

maybell ; can you write to me what you mention the main duties in your Schedule3 form.
I mentioned the following duties in my shedule3;
-Teach students using strategies for small and large groups,e.g. lectures.
-Train student in the hospitals how to carry out nursing care which required the nursing skills.
Note: I did not mentioned more details because the space as you know is too small.
Is the rejection reason: because I did not mention all my duty responsibilities.

yours look fine to me but then again i am not a CIC official.

I wrote the following and more (i dont have the copy with me write now to tell you all the duties that i wrote but here are some of them)

* Teach students using plan of lectures and stud sessions.
* Prepare, administer and mark tests and papers to evaluate students' progress
* Provide individualized study sessions
* recruit and Supervise teaching assistants
- supervise masters project
- mentor and student retention
- student recruitment
- sit on panel to evaluate masters project

Mine was so long, i had to use another sheet of paper. My duties included both 4131 as well as some teaching assistant duties.
