CIC's website is wrong about the FBI checks. They're currently taking about a month, from what I read on here (mine took around 5 or 6 weeks when I requested it in April of 2013).

Also, you need to understand that, until she has PR status, she is NEVER guaranteed entry to Canada. She may travel freely with an outland application in progress, as an outland application would not be affected if she was denied reentry to Canada at some point. Many Americans travel freely back and forth without problems, but some have experienced being denied at the border, as well. NOT trying to scare you, but you both need to be aware of the possibility.

CIC's information for FBI PCC is outdated. The FBI website shows that this is taking ~ 26 days (plus the time to mail the results/letter).

Her re-entry (with or without your marriage) will be the discretion of the Border Officer that she encounters at the border. Most Americans have no problem, provided they are not found to be inadmissible, but the duration of the visit is never guaranteed. Most get the automatic 6 months, while others get much less. No idea what the reasoning is for that.

Getting married before she leaves is ONLY required if you plan to apply while she is in the US on her vacation.

Well, we had a good talk yesterday, and arrived at a conclusion.
We were planning on using the time spent living together to learn about each other, we were going to use the conjugal sponsorship for that.
She wants to wait and see what the border agents do.
I feel like I've been run over by a truck.
Now we wait and see if she'll be granted re-entry when she flies back to Canada on the 21st. I sure hope the presence of an additional one-way ticket to the US helps sway the guards, and my letter, and health insurance.

Fingers crossed folks.

Well, the saving grace is that you did not waste your time, money and energy on a conjugal application that would have been denied. Just know that this 3 week break in your cohabiting, may negate the time that you've been living together, should you consider the Common-Law sponsorship later.

May I ask; what is the letter that you are referring to?

If she will have, in her possession, a letter describing how she has been `living' with you since last November....that could be an issue. The border officer has to believe that her re-entry is merely to VISIT you, NOT live with you. She may be better off not having it, or at least not presenting it.

Good luck to both of you! Falling in love with someone of a different nationality sure packs some extra challenges. I'm thankful I met my husband when I did, instead of just 6 months later. If we had had 6 months less time to get to know each other, to spend time together, to realize how special what we have together is...well, if we had met in March 2011 instead of September 2010, I'm not sure whether I'd have known to follow my heart when he had to move back to Canada.
