Who is a Commissioner of Oath?

I am filling out the statutory declaration of common-law, in the 5th box they needed a signature from a commission of oath and I have no idea who this can be and can't find info on-line.

Also I was wondering if I do a work holiday visa in another country does that mean I resided there for that time or am I considered a tourist?

My mom is a legal secretary and a commissioner of oath.

Hi there,

My partner is in Canada now and i am in Bermuda and i am trying to fill up this form Statutory Declaration of Common Law union. Do we both have to present together in front of Commissioner of Oath? Can we do separately without have to fly outside the country?

Please help...

If you have to complete this form then you must do it together, at the same place.

Keep in mind this form is not a requirement is a spouse is sponsoring the other spouse. Checklists show what Stat Dec of Common-Law is only required when a co-sponsor is involved (like for parent or child sponsorship).

Sometimes the visa offices ask for this Stat Dec form, but it's rare so most people just submit without it and let the office ask if they want it.

Typical rule is 6 months or more in a country means you were residing there and need a police certificate.

the awesome senior members are here. Rob_TO my question for the OP relates to them living separate, but in a CL relationship? Unless their being away is just a vacation, I think CIC may have a problem with recognizing a CL relationship where one partner lives in Bermuda and another in Canada. I may be way off base, so I leave for the pros :) :)

As soon as you reach 12-months continuous of living together, you are then legally common-law and can then also live apart and it won't break the common-law status. The most important part for living together, is during the 12-months qualifying time. It would be the same as if you're married and then live apart... you're still married.

5.36. How can someone in Canada sponsor a common-law partner from outside Canada when the definition says “is cohabiting”?
According to case law, the definition of common-law partner should be read as “an individual who is (ordinarily) cohabiting”. After the one year period of cohabitation has been established, the partners may live apart for periods of time without legally breaking the cohabitation.

So it is treated as marriage. Meaning the longer you live apart the harder it may be to prove your relationship to CIC. So just like in a marriage, there would have to be sufficient proof of visists, phone calls, chats, skype etc. Makes sense.

I am on work permit in Bermuda and my partner is working in Canada as temporary foreign worker. I have our previous lease agreement in scanned format. Will they accepted scanned document?

As previously posted by others I am not sure if you need the Stat. Declaration. I signed one for a friend of mine and his CL wife (I am a commissioner of oaths in Alberta), as they were required to provide it under CEC, they are applying for a PR separately, but have to disclose their relationship. For documents, they provided a photocopy of a lease (they were not required to provide an original under their PR applications).

Try to find out if you need a Stat Dec. first, if you do, and being in Bermuda, you may need to have it signed by a Notary Public and maybe even authenticated (as Canada is not a party of Hague Convention therefore all notarial documents must be authenticated by the proper governments in the country in which they are notarized) or a Canadian Consulate/Embassy may have a Notary Public at the Embassy/Consulate who can witness your signature, if they do, than no authentication would be necessary, as the Notary in an Embassy would be a Canadian. The USA consulates provide these type services at their foreign locations for a fee of $50 per documents, not sure if Canada does as well.

If you do need this document, than you will have to provide counterpart signatures, basically 2 copies of the same document, one signed by you in the presence of a Notary Public in Bermuda, and one signed by your spouse in Canada in front of a Commissioner of Oaths.

I think before you invest too much time, energy and money, try to find out if this is a document you really need.
