which visa office should we choose to send spouse sponsorship?

Dear all,

I am currently an international student studying in Canada and I am from China. I just got married with my Canadian husband. Now we are planning to do spouse sponsorship.

I have been studying in Canada for 4 years, when and where we met. Now he is working out of Canada and plan to come back next year.

CIC website said there were two different types of option for spouse sponsorship: sponsored person live out of Canada (faster ) vs sponsored person live inside Canada (2 years- OMG :eek: :eek: :eek: :eek: :eek: :eek:).

In my case,

1. I am a Chinese studying in Canada
2. My husband is Canadian.


In this case, Can we submit our application to Hongkong or Beijing for faster processing ? Or we need to submit it in Canada (Ottawa)?
CIC website listed the processing time for Hongkong or Beijing for 9 months, while that of sponsored person living Canada is 11 months + 9 months.


I have been phoning some agency in Canada, but different agency gave different answers. some of them said that you can not choose visa office and have to submit inside Canada, because you are living inside Canada. I am so confused now.

Which visa office should we choose? Could experts give me some advices?

The agencies that told you this are completely wrong, and sound like the don't know what they're talking about. I'm shocked so-called immigration agencies don't even know the basic rules about immigration.

You have 3 options here:

INLAND
1. You would process inland application though Vegreville Alberta visa office. As you said, total process will take 11 + 9 = 20 months total. Also with inland app you can't leave Canada. So if your husband will travel back to China and you intend to go with him, you should not choose inland.

OUTLAND
2. If you will have 1 more year of valid status in Canada, then you can apply with Outland application through CPC-Mississauga and then CPP-Ottawa office. Even though its in Ottawa, this is still an OUTLAND application. However since your student visa expires Nov 2014, you would need to send your application in immediately to qualify for Ottawa processing.

3. Otherwise you should apply outland through CPC-Mississauga and then Beijing or HK office. You can do this while living in Canada, and then return to China when your student visa expires to wait for PR to be approved.

Sounds like you should choose the last option... and just apply right away to Beijing or HK.

Thanks so so much for your detailed answers. I deeply appreciated your help. As you suggested, I plan to go back to China next year and I can not do the inland one.

For the last option, what is the differences between sending apply through CPC-Mississauga and then Beijing or HK office and directly to Beijing or HK office? I saw a lot people send to CPC-Mississauga then Beijing or HK? Why not Beijing or HK directly?

Every single outland app no matter where it's going in the world... first must be sent to CPC-Mississauga. CPC-M approves your sponsor first, then they will forward the application to Beijing/HK.

I am reading instructions online and I found 2 types of forms to fill, depending on spouse living inside Canada or outside Canada.

So the forms we should choose is :
1.If your spouse, partner or accompanying dependent child lives with you in Canada, Use this application http://www.cic.gc.ca/english/information/applications/spouse.asp

Application for Permanent Residence From Within Canada – Spouse or Common-Law Partner in Canada Class (IMM 5289)
if:
you are the spouse or common-law partner of a Canadian citizen or permanent resident,
you want to apply for permanent residence and
both you and the sponsor live in Canada.

2 use this

If your spouse, partner or dependent child lives outside Canada, use the Application to Sponsor a Member of the Family Class (FC).
If you are approved as a sponsor, the CPC will forward your family member’s application for permanent residence to the appropriate Canadian visa office to continue its processing.


In my case, even if I am studying in Canada and he is working out of Canada, we can still choose the second types of form (spouse living out of Canada), because we want to apply from outland. then We send the all the documents to CPP-Mississauga and they forward them to corresponding visa office later. Did I understand correctly?

Yes exactly. "Outland" just means your PR app will be processed by a visa office outside Canada. It doesn't matter where you are.
