Which is best: accompanying or non-accompanying?

Hello,

My boyfriend applied for a pr through the quebec skilled worker program in October 2015. Back then, we had lived together for 3months. His application was approved in Jan 2017.
We have now lived together for more than 1 year, which means we are now common law.
He has to declare a change of his marital status.
Is it better for him to have me as accompanying or non-accompanying family member? What would be the advantages of either options?
How long will his application be delayed if he added me as accompanying vs non-accompanying?
And finally, do i have to apply for a csq?

PS: we already live in Canada (him with a work permit, and me with a study permit).

With you as accompanying, you would get PR same time as your common law. It would delay his PR application but both of you would get PR.

With you as non-accompanying, you would not get PR when he lands. It won't delay his PR application, however he would have to submit a new spousal PR application on your behalf.

I have no idea how long the delay would be if you were accompanying. Whether are you accompanying or not, you would have to complete a medical exam as well since he has listed you as his common law. His application will not be treated as a new application. They are simply adding you to his application. Nothing more.

Even listing as non-accompanying will present a delay, as you'll need to do medicals and police checks and have CIC process the info. As well they may ask for more proofs that you have actually lived together 12 consecutive months.

I'm not familiar with the Quebec skilled worker program, but if it involves points to qualify, he needs to check if listing you as accompanying will affect his qualifying.

I assume if you're accompanying, you will for sure need to go through Quebec CSQ process as well (not sure if need to for non-accompanying).

If there is no effect to his own app qualifying, then there isn't much reason to not just include yourself as accompanying right now, and get PR together. Either way you're doing the extra steps for it. If you do as non-accompanying and wait until after he gets PR, he will have to go through whole family class application to sponsor you which can be a hassle.

As Rob said, there will be a delay regardless. The process for adding an accompanying and non-accompanying spouse is the same. You must still do the medical, obtain necessary PCCs and send in your forms/documents.

Oh yes. I forgot to add police check along with medical exam I mentioned earlier.

We are going to get married here in Canada in June. Do you think we should update his application status now to common law or wait until we get married, and directly change it to married?

We emailed the cic about his change in marital status and we are asked to submit different documents, one of them is the police clearance. I used to live in the US before coming to Canada, so I submitted my fingerprints to the FBI. It seems that getting the police clearance from the FBI will take some time. So my question is, should I wait for the police clearance and then submit a complete dossier, or should I go ahead and send the rest of the documents required with a letter of explanation about the police certificate, and submit this certificate as soon as I receive it?

Once he gets his pr after 3 years he can sponsor you, I suggest you do is get married and have him add you to his applicatiom

She is on a student visa she is already in canada

There is no requirement to be a PR for 3 years in order to sponsor. OP's partner could sponsor the day he becomes a PR, provided OP is properly included as non-accompanying.

The also don't need to get married, as they are already common-law.
