Friend of mine is applying to sponsor his wife who lives in Canada without status. (expired visitor status)

Which is the right address to mail application to?

That depends on whether she is submitting an Inland application, or an Outland application.

The Inland application offers some level of security against being removed from Canada because of her lack of status. Having said that, there have been at least a couple of people here, without legal status, that had submitted an Outland application (which can be done even if the applicant is in Canada).

It's a tough call, IMO.

can she send an inland considering that she has an expired status?

Actually, it appears that most people that are in Canada without legal status choose the Inland application, because of the Public Policy that allows most of them to remain in Canada. It's a much longer process than Outland and there is still no absolute guarantee that she will not be removed, but...most applicants are able to stay. The problem is, having to worry about things like health coverage, a driver license, etc., that a person without status is usually unable to obtain.

she has a child from a previous relationship (who would be as a dependent on this application) and she is also pregnant from the man she married in canada (the sponsor).

Does that change anything?

Is there a particular reason to do outland versus inland? seems like inland is the way to go?

Outland is usually faster...substantially faster!


If the baby is born before CIC receives the application, her receiving Conditional PR (Condition 51) would be removed, if she's been married to her sponsor for less than 2 years.

For Inland, she does not qualify for the Open Work Permit that is the appeal for a lot of Inland applicants. To them, it's worth the lonnnnng wait.

Did she already do a medical? Otherwise pregnancy can slow the process down as she cannot have an xray done until after she gives birth..

There was another person that had submitted an Outland application, without legal status, and received a letter telling them to leave and [attempt] to return to Canada to regain status, before their application could be processed. No idea how CIC determines who gets letters like these.

To answer your question:
If she is approved and does in fact receive the COPR to her address in Canada, she can flagpole or schedule a landing appointment at her local CIC office. The COPR is her visa.

interesting. was this recent? where was the applicant from? it's interesting that not everyone out of status receives this, knowing others have gotten approval no problem. i'm wondering if it depends on the citizenship of the applicant?

She informed the doctor and he still proceeded with the xray, apparently the medical community is no longer as concerned as they used to be years ago about xray radiation affecting pregnancy. I think they still covered her belly with the protective blanket.

It was within the last 8 months or so; the applicant was from the U.S.

Most out of status applicants submit an Inland application because the Public Policy from Feb 2005, allowing them to apply without status if they have an eligible sponsor, is apparently still in place.

That same policy does not translate to an Outland applicant, but as you've pointed out...some get lucky.
