When can my wife come to Canada

Hello All,

I'm a Canadian citizen and my wife is American. We have been married for almost two years and I currently starting our application for spousal spronsorship. I'm wondering if she is allowed to come to Canada during the application process.

We have our first child due in September and would like to move her and the child to Canada shortly after that but I cant seem to find any information regarding the rules of her travel in and out of Canada during the application process.

Any information or help would be greatly appreciated.

My wife is Canadian and I am American. Technically, your wife can come over anytime as a visitor during the application process. I stayed my wife the whole summer time last year and visited her multiple times during the application process. She can stay with you as a visitor for 6 months at a time. Depending if youre applying outland or inland -- both have advantages and disadvantages. For US citizens, applying outland is fastest (mine took less than 4 months from application received to confirmation of permanent residence). Note though that as a visitor to canada, your wife may be ineligible for medical benefits. For inland, im sure someone else will give you their opinion :)

I am American married to Canadian with app in process. I've travelled to Canada once since our app has been in process. They just asked me the reason for my visit, I told them to visit family. They asked what family, I told them my wife. They asked when was the last time I visited Canada, I told them January. And I was on my way. No problems. I did have a return flight and my receipt for application fees in case I needed to show that I was following the rules and had an app in process.

Note that until she is a PR, your wife can't "move" to Canada, nor can she bring all of her belongings. She can enter as a visitor while the PR app is processing, with a few bags like any other visitor.

American outland apps average around 4-6 months, so if you apply now, there is a good chance that her app will be processed around the time she plans to come to Canada. Part of that depends on whether you guys are willing to have her do the chest x-ray while pregnant; if not, then the app definitely won't be completed until after the birth when she undergoes the x-ray.

When the child is born, apply ASAP for a Certificate of Citizenship. While it takes several months to be processed, you can concurrently apply for a limited validity Canadian passport which can be issued quickly (with proof of imminent travel). Without such proof of the child's Canadian citizenship, you may face issues getting her/him provincial health coverage when they come here.

Just like inland, your wife can stay inn Canada while you'r doing your outland. Like everyone else mentioned, she would only be able to be here for the 6 month visiting timeframe. She would just state duel intent as her purpose of crossing and make it clear she will go back within her timeframe if her PR isn't completed. If she applies for an extension once she has been in Canada visiting for 6 months, she can get extended again for a year (if they approve). I just got my 1 year visitor extension last month.

Edit: also Congratulations on the pregnancy!! You should have her phone her insurance to see if they will cover her in Canada. Mine does (aetna)
