I am a Pre- June2010 applicant and hv been looking fwd to receiving MR from VO,Ghana at least as my e-cas shows your application was reviewed and started processing from 9 Jan 2012 for over a couple of months ago only to recv mail on 14 March from the VO that my application for PR under FSW1 with NOC 1111 was refused stating that i do not have capacity to become economically established in canada as my application was assessed and sets out the points:Age:10/10,Edu:20/25,Lang:11/24,wk Exp:21/21,Arr Employment:00/10,Adapt:00/10. Total:62/100.1. how come i was awarded 20 when i hold HND and my credentials was assessed by ICAS-Canada and a report issued to be equivalent to Applied BSC(4yrs) in canada.2.i think the score 00 for Adaptability was not justified as i submitted my spouse credential(HND).pls,all seniors forum members,help me out in good time.can the VO still reconsider my case?at least if i should forward an appeal letter within the next few days couple with a scan doc of my ICAS report&my spouse certificate.urgent response plssssssssss!.Thanks.wolex

So sorry to hear that! Now let's look at edu and adaptability where u seem to have a problem

1. What is the total number of years of full time edu have you had?
The VO gave you 20 based on
"A university degree of two years or more at the Bachelor's level, AND at least 14 years of full-time or full-time equivalent study"
If you have had a total of at least 15 years formal education, then VO erred and should have given u 22 points. I think VO's main focus is the total number of years you have spent in formal edu. So even if as per the credential assessment you have spent 4 years, would you have had at least a total of 15 yrs in edu?

2.If your wife had had at least 12 years of formal edu plus her diploma, you can claim 3 points
and if she did at least 14 years, you will claim 4 points.

So potentially, you are looking at extra 2 points for ur edu and 3-4 points for adaptability. So you are hanging on to extra 5-6 points if VO reassesses your case.
Remember the total number of years of formal education you and your wife have each is crucial in determining this!

Tnx awfully 'our' wonderful Mandie and other forum members whom i believe wl response passionately to my case.i had a 16 full years of formal education couple with that of my spouse.of which i think i shoud have 22pts and at least 4pts from my spouse for adaptability from the self assessment i did b4 submitting my application.pls,am still waiting for your responses at least to guarantee my chance of any possible favourable reassessment by the VO.Thanks and God bless u all.wolex

If you you and your wife spent at least 16 years each in edu, then VO erred in indeed. You should have been awarded 22 points for education and 4 points for adaptability. Without doubt, they made a mistake. Time to start putting together a reconsideration request. You should indicate the number of years you have spent at each educational stage for both of you and attach certificates for both of you. This is the second time Accra had made a mistake in assessing education within the last 2 weeks. And good luck!

Many thanks!.Thanks for your great concern.i hv been planning to forward a reconsideration Letter to Accra as you have rightly suggested.pls,i earnestly covet ur prayers and other forum member for a favourable response. NB:in the heartbreaking mail sent to me by Accra,i also discover another File no other than the one i was given initially.what is the implication of this?And i've been checking my e-cas since that 14 march and my status still showing IN PROCESS.could it be that there is a mix up?.pls,shed more light!.Thanks and wishing every1 hapi wkd.wolex

In my opinion I think you should be awarded 22points for education, regarding your wife did you include her cerificates in your application and what is her level of education?

Thanks for your contribution so far.i also submitted my wife's notarised Educational certicate couple with her academic transcript.she also hold HND.Looking forward for further response from other forum members.Thanks.wolex NB:pls,still comment on the two different File no and the IN PROCESS thing on my e-cas.

ANY HELP GUYS:REJECTION CASE

........however we were unable to award you any points for adaptability as you did not provide conclusive proof of your relationship with your brother in Canada or that he was a resident there...............I am therefore refusing your application. Thank you for the interest you have shown in Canada.

NVO had requested for a copy of my brother's PERMANENT RESIDENT CARD which I did provide.A copy of my brother's card is in my file and therefore makes this decision is ridiculous .

I should have scored 68% but given that the visa officer refused to award me points for adaptability my final score stood at 63%. 67% is their pass marks.

Is an appeal option viable for NOC 1111 and what are the chances of success? Note that NOC 1111 is no longer in the list.

Secondly, what are the financial implications of an appeal? Can I do it myself or must I go through an Immigration lawyer?

Finally, Who do we address this appeal to or to which office is it addressed to? Can I simply do a mail to the Visa Office concerned?
