What is Happening to AINP applying under H1B visa from 2011-2012?

To be honest, I exhausted...I'm giving up with my US green card process once I get my Canadian PR. I'm in the last step for US green card...My priority date here is September 2010, but I don't think I'll get something before 5-9 years according to the average processing time now... I have a friend that filed in 2008 and the priority date now is 2006 after 4 years of waiting he still isn't sure how longer he has to wait... If you think the backlog in Canada in long, the one in US is longer and uncertain. But if you have the patience to wait, keep waiting...I'm out of here as soon as Canada welcomes me...It's not fair after 14 years waiting as a legal resident in the US and two American children, house, credit, job, paying taxes, etc... no to have the security of belonging to a country...To feel that at anytime they can just dismiss you as a disposable item if they don't need you. They are putting illegal aliens ahead of legal aliens...No fair. Immigration in the US is awful and unfair... So, forget it. 30 or 50 Years from now you will see how Canada immigration pays off in contrast to the US. For Canada, if you are a good citizen, do the right thing, are academically prepared, and Speaks the language you are in...You are welcome...In the US, there are so many absurd and political games that don't let immigration and ultimately the country move forward.

Well ! The trick here is to apply for your Green Card and just forget about it. I am in an ugly situation, my H1B is expiring at the end of this year (6 years is over) so I really have to get my butt off America. I can totally relate to your post, I lived in USA for 12 years myself and now I cant believe that all of a sudden I have to just get up and go because I do not have a visa to stay over here. It is really crazy. As far as your situation is concerned, if you have two US born children, they can always sponsor you down the road.

It appears their entire visa process is like a game, you have to have all ducks in a row. Going from F1 visa to H1B is one interesting episode in itself. Person has to time it right, with job offer, visa application, start date, etc. After that, the wait starts with GC, if you can even find an employer who will do it. Its really crazy ! USA gets way too many immigrants and they seem to not care about keeping them around.

It's great idea to gather all our timelines and add to the tracksheet. Anyway, my information is already added to this tracksheet a couple of weeks ago.

I hope you really got frustrated with US green card process. In my case, I am in the US for the past 4.5 years (my H1B is valid until March 04, 2014) and requested my company to file for my green card, but they haven't initiated yet. I even don't have any hope that they do it. I have the exactly the same feeling like you. If I get Canada PR, will move there as soon as I can. We do have a 2 years old son (US Citizen) and wants to get settled in Alberta before he starts his schooling. Have no idea where exectly in Alberta. Praying God almost everyday to get Canada PR...:)

I have sent "attested copy of my no-birth record certificate + notarized self declaration (for me) and affidavit from my father-in-law + notarized self declaration (for my wife)" to my attorney. I guess the attorney is going to re-submit my application this week.

Our 10th standard certificates did not show the full names of either ours or parents. So, the attorney said, it's better to provide no-birth record certificate or affidavits and also the self declaration for both of us.

@ Dell.... Nicely summarized. I am on the same boat. Though my company has started my GC process under EB 2, I'm least interested in my GC. I have been here in the US since 2002. I just can't tell them not to apply for obvious reason. My 6 year H1 B staus is expiring on Sep , 30 2013. I'm hoping to emigrate to Canada before this year. The sooner the better.

I sense your situation man, my brother in law did exactly the same thing: F1 for his entire undergraduate school, H1B with a nice company who dumped him at his last H1B visa year, then went back to school to complete his master with the hope of getting another OPT, then H1B, then a chance to get a GC...Did not happen...From his second F1 visa he went to H4B under his wife H1B visa as his dependent. So now, over 16 years later in the US, he still does not have the right to work or do anything in the US besides caring for his children...At least they don't pay for daycare...Funny! His wife needs at least another 4-6 more years before getting GC...So, if he is lucky he will get a GC after 20 years in the US. The only reason he is staying are his kids, but this is not fair...I do not want to relate to this story. As I said, the system does not work; and as Sayara said, US does not care for his immigrants...

I feel that it is exactly what I want to do, sell everything I own here, collect my money, move to Alberta, have my kiddos attending school, work, perhaps start a business and start traveling and living life instead of waiting for a broken system to get fix. Why does it matter to be here if you feel a perpetual uncertainty. I relate to you guys, and I do not want to believe that we are disposable people at the mercy of the system...

SOME COMMENTS:

1. The officers in Alberta are smart, I have to say. They take the guys with h1b in the USA and believe they are true contributors for Alberta economy. I think they are 100% right. All of these guys have got experience, skills, and expertise in their fields in the US, which are deadly needed by Alberta. Second, these guys have no any problem to adapt to Canada immediately as soon as they immigrate to Canada, no language barrier, no culture barrier, no nothing; Third, most of these guys have already got US education and diploma. And most importantly, they have got professional licenses to perform their jobs. For instance, I have got a license in the US, which only 5000 people in the world have it to perform medical practice in the US. We are ready to serve Canada. What we need is that CIO does what they should do, speed up the process. The sooner, the better. We are ready, CIO, are you ready?

This is an interesting one. Its hard to believe your brother in law is still hanging in this country after living so many years with no GC. I am assuming he is not a very ambitious person and he really is simply wasting his life. He should live outside USA for atleast 1 year before he is eligible to get another H1B.

Permanent residency is one part of the story, job is another. Having Permanent residency and no job can also be a problem, if you haven't thought of things in that line. They both go together and are equally important. One of my friends brother migrated to Australia for his Phd, he became a citizen before he finished his Phd, but could not find work and has been unemployed for the last 1 year. When i spoke to him, he told me I am too concerned about PR, and said that job is more important. He never faced immigration problems in Australia. I felt very miserable in my previous job and was always thinking about my visa, it appears it was job problem but my visa status was adding more oxygen to the problem since I could not leave that job.

I also have a pending application for Australia, as I was not certain if I could get Canadian PR. Did you all only apply to Canada as backup ?

It seems like the Newdelhi office is very fast, they have been issuing PPR in less than 6 months. Do you think our cases would be finalized in 12 months, that is by the end of this year since most of us applied in January ?

You are totally right about the smart move the Alberta government has made. They know H1B visa holders are ready to contribute from day 1. They know the majority, if not everyone, comes equipped to face any challenge; plus if they rightfully assume that if we got a visa and a job in the US, we have overcome many obstacles and preparation...They are just unleashing our potential in Canada. It would be great to get some people who immigrated already to Alberta under H1B visa to talk about their experience in Canada. I'm totally with you: Are you ready Alberta?
