What happens in waiting time for PR sponsor application??

Hi, I'm new to this immigration thing. I've been researching for a few days since my girlfriend and I are thinking seriously about marriage.

I'm 28, Canadian (born and raised). She is 26, Thai, and has been here on a work Visa since last June. Her sister is also here, she is married to a Canadian guy too and they have a house and everything.

Anyway, I see that there's an income requirement, but it is waived when you are sponsoring a spouse. I was a little worried about that because of my student loan. But I have a job that pays enough and I get full benefits (spouse included if I have one).

Then I notice that they could reject the application because they do not believe the relationship is real. But through stories in this forum, I see that things such as phone records, photos, emails, IM conversations can help in proving this.

If any of the above is incorrect, let me know.

Now to my real issue.

Her Work Visa ends in May 2010. The way we are talking, we would like to get married possibly this summer ... though with the economy how it is, we might push it until later in the year.

I am not entirely sure how the waiting process works. If we get married, then I apply to be her PR sponsor here. We have to wait what seems like 6-18 months until it is approved/rejected. And from what I read in the forum, if we apply from within Canada it takes longer than from abroad. Ok, fair enough I suppose. However ... what happens with in that 6-18 months. Say it takes 18 months. That would mean her work permit is expired and as she tells it to me, she would have to go back to Thailand, apply, and wait 6 months for another work permit.

I am just curious, is there any way to keep her in Canada? With a Visitor Visa she cannot work, so that is not really an option.

Also, does the fact that she has some immediate family here help her cause for PR?

If anyone can shed some light on what goes on behind the scenes that would be greatly appreciated.

When you send in an inland sponsorship application (processed completely within Canada), you can also send in an application for an open work permit at the same time. After the first stage approval which would be in 6-7 months if all goes well, your spouse would get an open work permit. She would get PR maybe in 12-18 months.

Another thing you can do for a faster application is to apply outland. She would get the PR faster that way, maybe 6 months. She has the right to have her application processed in Thailand or because she is legally in Canada with a 1+ year work visa, she has the right to have her application processed in the US. The drawback with an outland application is that if an interview is required, she would have to go there.

Then again, the drawback with inland is that you are not advised to travel while it's being processed so in case there is a family emergency in Thailand in the next 18 months, she would be stuck in Canada.

Woah ... so let me get this straight. Since she has a 1+ year work Visa, we can apply outside of Canada while she is still working in Canada AND she doesn't have the travel restriction of an inland application? So, if she has a family emergency, she can go back to Thailand for a few weeks or so. Sounds too good to be true. haha ... but if you say that's how it is, I'll definitely research and look into that.

It's not a problem if we have to go to the USA for an interview.

However, would she still be able to apply for an open work visa if we have an outland application in the US?

She can not apply for an open work visa with an outland application but by the time she would get the open work visa with the inland, she will already have PR on the outland.

I have a question Leon...
How would you go about getting your application getting processed in the States? You mentioned that if you have a 1+ visa, you have that option of having your application processed there. We were looking at doing an inland application because the processing times at the office in Guatemala are anywhere from 8 to 19 months. That just seems so long to us, especially when you cannot even apply for an open work permit. But if we could have it processed in the states, and it would take about the same amount of time as it would to get first stage approval, that would definitely be something we would look into.

If we had to go to the States for an interview, would my husband have to get a visa for the states first???

It would definitely be a problem if you are called for an interview in the US and can't go there because you can't get a visa. I don't think it would be a big deal to get a visa for the US stating Canada immigration interview as the reason. Maybe you should try to get a visit visa there first to go on a short trip and see if it's any trouble.

Leon the chances of getting a US visitor visa to attend a Canadian Immigration interview are close to nil. As the US feel that the applicant doesn't have roots in Canada nor their home country and if refused would likely stay in the US. Same reasoning applies for overseas spouses of Citizens and PRs who want to visit Canada.

I guess that is bad news for them then :( A multiple entry visa for the US perhaps?
