Hello,
In September 2004 I came to Canada as a student from Colombia. I met my husband at school and we married in 2005. He was a Canadian citizen and sponsored me to become Permanent Resident. Unfortunately things didn’t work for us and we ended up separating after 3 years together (2 as a married couple).
I’ve been living alone since 2008 and separated from my ex since. Our divorce was finalized in May 2009 (In order to get a divorce in BC you need to be living apart for at least 1 year).
I met my Argentinean Boyfriend when I was separated and started dating him in May 2009. We've been together for a year and we are planning to get married in September 2010.
I'm planning to be his sponsor under the family class (within Canada). I'm wondering since I’m divorced, would be this a red flag for immigration and would this affect immigration process at all? Please note he does not have legal status in Canada.

Well it shouldnt be a problem sponsoring him as for the divorce that wont be the problem.They may look at your file a bit closer since you are still a PR,but thats about it.And as for his status....running out of status(visa ran out)is not usually an issue,the issue will be they are going to want to know how he got here,why he is here,and where does he have legal status.And they may tell him he has to leave and you sponsor him from outside.
Being out of status,and being here illegal are two differnt things even though they seem they are not.They are going to ask for his residence what will he say.If he says Canada they will want to know his status?Then thats where it will get tricky.
Maybe a more senior member can tell you different but i dont think you can sponsor someone who is illegal here.Someone who has run out of status yes.
