Hi,

Need advise. I am Canadian PR (Filipino), would like to sponsor my partner who is currently in the Philippines. I am separated to my ex wife, also in Canada and we have agreed to file a divorce. She applied for a TRV and was refused twice. We also have travelled together in other countries before I arrive to Canada and is planning to visit her soon in PH. Since we (ex and I) got married in PH, and divorce is not recognized by PH law, what are the chances if I sponsor my partner to come to Canada as conjugal partner? Or do we wait for divorce and get married to other countries which recognizes divorce? TIA

My ex and I got married in PH. My partner and I have been together for 5 years, have friends and relatives to prove our relationship and have joint bank account in PH. Your timelines are confusing. Can you clarify when you first landed in Canada and became a PR? Are you saying that you first became a PR in 2016? Or was it earlier? If earlier, when?

In that case I don't understand how you could have been in a relationship with your current partner for 5 years.

Were you no longer in a relationship with your ex-wife when you landed as her dependent in 2016?

So how on earth did you land as a spouse in 2016 if you were in a conjugal relationship with someone else???

Sounds like you committed massive immigration fraud to get your own PR status illegally. You should never have gotten your PR status in the first place. Any attempt to sponsor your partner will just end in your PR status being revoked and you being deported.

You'll need to make a choice, stay in Canada without your partner, or live with your partner back in the Philippines. There is no future for you in Canada with your partner, unless they have education/skilled work experience to qualify under an economic immigration stream completely separate from you.

And if IRCC ever learns of your conjugal relationship and fraud/misrepresentation in the future, your own PR status can be revoked at anytime.

Yes, since 2011.

In that case you're in a bad situation and need to forget about sponsoring your current partner.

This means you broke the law and obtained PR through fraud / misrepresentation. Since you were no longer in a relationship with your ex, you should have been dropped as a dependent from her application. Because you obtained PR through misrepresenting your relationship with the primary applicant, CIC could revoke your PR status at any time in the future (even revoke your citizenship once you are a citizen).

There are no options for you to sponsor your conjugal partner. If you try, all this will do is alert CIC to the fact that you obtain PR through fraud.
