Hi Everyone,
I became a Canadian citizen this month. My kid born in US last month. I wanted to apply Canada PR to my child. Please let me know how to apply and what are the documents to gather and process to apply.

Is there any residency obligations for minor to stay in Canada 2 out of 5 years. Or she can stay outside Canada and get citizenship. Please clarify someone regarding this.

Your help would be appreciated!

Thanks,
Sai.
So let’s cut to the chase here . You always intended to move to the USA versus staying in Canada . Hence that’s why your spouse in the USA SPONSORED you , versus you sponsoring her . And the spousal sponsorship for the USA is way longer than Canada’s. You knew exactly what you were doing . The only hiccup was that your child was born prior to you getting Canadian citizenship. Now you’re concerned about collecting another passport ( Canada ) for your US born child
. As mentioned you have to show proof you’re moving back . It’s common sense . Why would Canada grant PR to your child if you’re not intending to move back ? You can’t have everything

There are multiple factors with us which I cannot go into detail in public forums. But that is why I am gathering all information to make sure we do the process correctly and for the correct reasons. This is not to get additional documents or fanfare. Thank you for the response!

Here's the problem: we keep telling you that PR status is NOT intended for those who do not intend to live in Canada.

Clearly you and your spouse do NOT intend to move to Canada. Certainly your spouse does not.

So the ONLY logical way in which you could sponsor on basis of intent to return to Canada is by declaring, effectively, that you and your spouse have separated. Because otherwise you'd be applying for spousal sponsorship, with the child as a dependent.

Your spouse SHOULD be concerned. Signing a doc that she is giving consent and declaration to be separated, permanently (effectively) from her child, is not a good idea legally unless that is what she intends.

Even so you can expect that IRCC will be asking questions about the truth of your intent to return to Canada without your spouse but with your young child. Which - let's face it - is not actually true, is it?

So I for one am kind of done with advice in this case, at least until you better explain. You've had it explained, PR status is not intended for those who just want to collect more docs and passports for their kids. Maybe you can figure out a way, maybe you can find a lawyer to charge you big bucks to assist, but I don't see the point.

The logical / normal way to move forward is to sponsor your spouse for PR and include the child as a dependent in the same application.

If you end up doing something else and move to Canada with your child and without your spouse, note that you will need a letter from your spouse at the time you travel giving you permission to move the child to a different country.

Ok, got it. Another question: I know my spouse has to maintain the residency requirements of staying minimum 2 out of 5 years, but for my daughter who is 2 months old, I can apply citizenship for her as soon as she gets pr right?

Yes, although I believe child has to remain resident in Canada until citizenship is received.
