My mother was visiting me in December but stuck due to Covid pandemic. We wrongly assumed that situation will improves soon so she applied for 6 month extension. The extension is still being processsed but presumably she is allowed to stay while they are processing the application. Yes as pandemics continues to rampage in Europe (and even here, in Quebec province) she, diabetic senior, is afraid to travel. Is it good idea to apply on humanitarian grounds? She is the only close relative, though her sibling lives in her home country. She also worries for the state of her condo and if pandemic is over in few months she is might decide go home. Will applying for humanitarian ground prevent her from getting visitor visas or applying for immigration in future?
 
I wouldn't suggest H&C because your mother would have to show her establishment in canada and more. Have you considered super visa?

Not a good idea based on what you've written.

She should simply apply to extend her visit by another six months if she wants to stay longer.

H&C takes around three years to process and she should remain in Canada without leaving for this entire period. The pandemic is everywhere (including Canada) and I don't see this being an argument for H&C. If H&C is refused, this typically cancels her visa and makes it much more difficult for her to visit in the future.

If she returns back home in a few months after applying for H&C, this will demonstrate that there really isn't any basis for her H&C claim.

Agree that extending her visa is the best idea. No large difference in covid between Canada and Europe to justify her need for permanenet residency in Canada and there may be a vaccine by the time her application is processed.

1. She must be out of Canada for supervisa. 2. Applying for supervisa does allow you stay legally in Canada

You said she has siblings in her home country.

That’s why there’s the P&G program or Supervisa
People are stuck all around the world . If there wasn’t a pandemic your mom would already be at her home .

The punishment would be that the success rate for H&C applications is extremely low outside of Canada and that once she applies, and then goes home, her chances of obtaining entry or a new visa is also extremely low.

I lived in Canada for over ten years under h & c now l a have been back in Zimbabwe for 8 years and obviously my PR was revoked and now am trying to go back..l have four Canadian born children that are here with me. What wouldbe the best way go about it..We really need to go back.

Either qualify for PR again or when your children are adults they can try and sponsor you when they earn enough income. All information on express entry programs are online. How old are you?
