I wanted to seek your advice and guidance regarding the case of my parent's family visitor Visa application which got rejected around a week back. I hope there is some sort of clarity about it. My parent's prior immigration history to Canada makes it more complicated about how to proceed. Kindly help.
Here is how it goes:-
My parents have previously lived in Canada from 2006 to 2007 for 1 year as Permanent Residents before travelling back to India and never return again due to family circumstances with their PR card only valid till 2011. I have lived in Canada as an international student from 2017 to 2019 and currently being a PR.
In 2019, I invited my parents to visit Canada on the occasion of my convocation and they submitted their family visitor Visa application in May 2019. Within 10 days of submitting the application, my parents got a notification from Canadian high commission that their status in Canada is still that of a Permanent resident and they shall either renounce their PR status by themselves or apply for a PRTD (travel document) where a Visa officer will check whether they have completed residency obligation in the past 5 years (which they clearly hadn't) and then decide if they can come to Canada or not. This was the first time I came to know the difference between a PR status and PR card and my parent's also came to know that their status was still that of PR.
Clearly knowing that my parent's cannot return to Canada as PR (based on residency requirements) and wanting them to attend my convocation as a Visitor, my parent's voluntarily renounced their PR status so that the application for Family visitor visa can go ahead and be processed.
However, the Visa application was rejected and the reasons given for rejection were pretty generic like past travel history, finances shown and that they might not return. Their application was rejected in July 2019 and they were not able to come for my convocation unfortunately.
However, an year after the pandemic got over and after myself being a PR in Canada, my parents applied for a Visitor Visa application once again earlier this month. This time my parents provided all the immigration history and how their PR status was renounced in 2019 and despite that they got their Visa rejected in 2019. They explained that they are no longer Permanent residents and no longer want to live in Canada and just want to travel as visitors and provided they proofs of current employment letters and all the details supporting it.
However, in second week of June 2023 as well, their Family Visitor Visa got rejected once again and this time the reason provided was that of Para 179(b) which was used by the Visa officer to reject the application within 8-9 days of submitting the application (since the biometric was already valid). They also stated that financial assets and situation is not sufficient for purpose of travel (even though my mother and father have both showed enough liquid assets in application) and stated that their Purpose of visit is not consistent with details of visit provided in the application which is also pretty weird (since they have mentioned consistent 2 week travel dates and the purpose of travel being able to celebrate my birthday with me).
The immigration consultant my parents hired suggests that the applications these days have been getting rejected after being sorted with AI and anywhere there is a travel history and bit of prior immigration suspicion, they have setup automatic rejection of even study permit applicants and they have been quoting Para 179(b) (https://laws-lois.justice.gc.ca/eng/regulations/SOR-2002-227/section-179.html) in all these cases (including study permits as well).
Upon being advised and checking further with others, I have applied for the GCMS notes of my parents associated with their UCI and their application number of June 2023 Visa application.
Can anyone please suggest what should be the way forward for getting the Family visitor Visa now ???? as I am pretty much sure that we have provided all the documents and supporting details of Invitation, purpose of travel, forms and financial records as well. We have also stated that my parents have my younger brother to take care of and he is still in India and that he is one of their ties in India and disapproving any of their immigration ambitions.
Kindly suggest and advise what can we do in this case and how can my parents prove that they only intend to visit Canada and get their Visa approved. Another theory provided by my parent's immigration consultant is that these days when someone applies for a TRV second time once again in a short period of time with nothing but minor modification in Purpose of travel...........there is a greater chance of more human involvement in processing the Visa application than with AI like at the first time which actually brightens the chances of my parent's getting their Family Visitor Visa approved. Kindly let me know about this as well.
