Visitor Visa rejection for my parents who have a complicated immigration history scenario. Kindly Help !!

Hi everyone !

I wanted to seek your advice and guidance regarding the case of my parent's family visitor Visa application which got rejected around a week back. I hope there is some sort of clarity about it. My parent's prior immigration history to Canada makes it more complicated about how to proceed. Kindly help.

Here is how it goes:-

My parents have previously lived in Canada from 2006 to 2007 for 1 year as Permanent Residents before travelling back to India and never return again due to family circumstances with their PR card only valid till 2011. I have lived in Canada as an international student from 2017 to 2019 and currently being a PR.
In 2019, I invited my parents to visit Canada on the occasion of my convocation and they submitted their family visitor Visa application in May 2019. Within 10 days of submitting the application, my parents got a notification from Canadian high commission that their status in Canada is still that of a Permanent resident and they shall either renounce their PR status by themselves or apply for a PRTD (travel document) where a Visa officer will check whether they have completed residency obligation in the past 5 years (which they clearly hadn't) and then decide if they can come to Canada or not. This was the first time I came to know the difference between a PR status and PR card and my parent's also came to know that their status was still that of PR.
Clearly knowing that my parent's cannot return to Canada as PR (based on residency requirements) and wanting them to attend my convocation as a Visitor, my parent's voluntarily renounced their PR status so that the application for Family visitor visa can go ahead and be processed.
However, the Visa application was rejected and the reasons given for rejection were pretty generic like past travel history, finances shown and that they might not return. Their application was rejected in July 2019 and they were not able to come for my convocation unfortunately.

However, an year after the pandemic got over and after myself being a PR in Canada, my parents applied for a Visitor Visa application once again earlier this month. This time my parents provided all the immigration history and how their PR status was renounced in 2019 and despite that they got their Visa rejected in 2019. They explained that they are no longer Permanent residents and no longer want to live in Canada and just want to travel as visitors and provided they proofs of current employment letters and all the details supporting it.
However, in second week of June 2023 as well, their Family Visitor Visa got rejected once again and this time the reason provided was that of Para 179(b) which was used by the Visa officer to reject the application within 8-9 days of submitting the application (since the biometric was already valid). They also stated that financial assets and situation is not sufficient for purpose of travel (even though my mother and father have both showed enough liquid assets in application) and stated that their Purpose of visit is not consistent with details of visit provided in the application which is also pretty weird (since they have mentioned consistent 2 week travel dates and the purpose of travel being able to celebrate my birthday with me).
The immigration consultant my parents hired suggests that the applications these days have been getting rejected after being sorted with AI and anywhere there is a travel history and bit of prior immigration suspicion, they have setup automatic rejection of even study permit applicants and they have been quoting Para 179(b) (https://laws-lois.justice.gc.ca/eng/regulations/SOR-2002-227/section-179.html) in all these cases (including study permits as well).
Upon being advised and checking further with others, I have applied for the GCMS notes of my parents associated with their UCI and their application number of June 2023 Visa application.

Can anyone please suggest what should be the way forward for getting the Family visitor Visa now ???? as I am pretty much sure that we have provided all the documents and supporting details of Invitation, purpose of travel, forms and financial records as well. We have also stated that my parents have my younger brother to take care of and he is still in India and that he is one of their ties in India and disapproving any of their immigration ambitions.

Kindly suggest and advise what can we do in this case and how can my parents prove that they only intend to visit Canada and get their Visa approved. Another theory provided by my parent's immigration consultant is that these days when someone applies for a TRV second time once again in a short period of time with nothing but minor modification in Purpose of travel...........there is a greater chance of more human involvement in processing the Visa application than with AI like at the first time which actually brightens the chances of my parent's getting their Family Visitor Visa approved. Kindly let me know about this as well.

GCMS notes may be worth a shot too

Do you have siblings and where do they live? How long have they requested to visit Canada? Other family in Canada? How much liquid funds have they shown (not FDs)? How did they get PR in Canada the first time? She you considered applying for a supervisa?

Regarding the ties to the home country.......my parents have shown property under their name and its papers......their current respective jobs and NOC letters from their employers where they work. Informed about presence of my younger brother (aged 17) who still lives in India and in terms of money.......my father has showed liquid funds of 67k CAD approx and mother has shown 40k CAD approx.

Do they own a home in India? Yes and have provided the documents for the same

Do they live with your grandparents? Nope. I only have one maternal Grandmother as of now and my mother has mentioned about her in the family form

Are they still employed? Yes and informed.

Do you have siblings and where do they live? Yes and he lives in India and he is not an applicant for visa.

How long have they requested to visit Canada? The requested visit to Canada was 2 weeks/ 15 days as informed in the form as well as Purpose of Travel letter

Other family in Canada? None in direct blood relation apart from me.

How much liquid funds have they shown (not FDs)? My father has showed liquid funds of 67k CAD approx and mother has shown 40k CAD approx and this is not in FDs but in saving accounts and others.......so basically we submitted bank certificates indicating the current available liquid funds

How did they get PR in Canada the first time? They got Visa as Foreign Skilled Worker back in 2006 on point based system as far as I remember

She you considered applying for a supervisa? I haven't considered applying for Super Visa yet because I am more interested in this Temporary one even though I am aware about that option.

One of my query was if the reason for travel for 2 weeks was not a strong reason........my parents stated that they haven't visited me in a long time and I've been feeling homesick and they would like to celebrate my birthday with me this time in those 2 week...........let me know if you think this reason is strong enough or not. Thanks

They have a pretty good profile especially if your sibling remains in India. I would consider applying again and stressing the ties that ensure they have to return. If your sibling is under 18 that would be even better. Is your sibling still a PR? That could be one of the issues.

My sibling is under 18 and is gonna turn 18 in one week's time to be precise. Also my sibling is not a PR anymore as his PR was also renounced along with my parents 4 years back. So he is just student in India as of now..

Importantly.....GCMS notes of my mother have arrived last week and here is what is written in the last page of the GCMS notes which we received as per the IRCC Visa officer. Kindly check and suggest what could be the reason as I got it checked with an immigration consultant in India and he said that all the grounds have been covered where the reason is mentioned in the GCMS notes and it doesn't make any sense. Here is what's mentioned:-


"
I have reviewed the application.
I have considered the following factors in my decision.
The applicant's assets and financial situation are insufficient to support the stated purpose of travel for themselves (and any accompanying family member(s), if applicable). Bank statement is not supported with evidence of income. Limited evidence pertaining to the source of these funds. In the absence of satisfactory documentation showing the source of these funds, I am not satisfied the PA has sufficient funds for the intended proposed stay in Canada.
The purpose of the applicant's visit to Canada is not consistent with a temporary stay given the details provided in the application. Relationship between PA and host established.
Weighing the factors in this application, I am not satisfied that the applicant will depart Canada at the end of the period authorized for their stay.
For the reasons above, I have refused this application."
