Visitor Visa refusal..Reapplying

Hello,

I am a Canadian PR. And recently migrated to Canada last September.
I had applied for my mother's visitor visa for Canada and today I got refusal with following reasons...

You have not satisfied me that you would leave Canada at the end of your stay as a temporary
resident. In reaching this decision, I considered several factors, including:[/b][/b]

1)Family ties in Canada and in country of residence
2)Purpose of visit

My father is Green card holder and he is right now with us in Canada for few days to visit us.

Please guide me on above mentioned points, that what I should cover within my covering letter as , I want to reapply for my mother.

if u elligble for super visa then u can apply for super visa,otherwise u can reapply trv visa again with proper doc's like invitation letter ur bank statements,residence proof,and same docs from ur mother bank statemets approx 10,000 CAD.property doc's.and u have to show strong ties from ur mother country.

1) Your mother has family in Canada, but you did not demonstrate she has a lot of family in her home country (or current country of residence). Therefore the visa officer concluded that she has strong family ties to Canada (you), but not to her home country, therefore she might be motivated to want to stay in Canada and not return. In a new application, you should emphasize her ties to her home country. If she does not have much family, show other ties (if she has a job, property, etc.)

2) This is hard to say, but you may have ticked the wrong box. Maybe you put "tourism" instead of "family visit" and the visa official concluded you are not telling the whole truth. You may have also worded things in a way which alarmed the official. For example, you may have put "my mother is coming to take care of my children for a while" (I don't know if you have children, I'm just giving an example), which might make the visa officer think she would want to stay permanently to help you with taking care of them. Putting "my mother would like to come and visit and see me" would be a better thing to say.

Also, think about it - you came in September and now you are already inviting your mother. CIC might think that you are now trying to "quickly" get your parents into Canada by exploiting some loopholes in the system. If you wait a little longer (say 1 year after moving to Canada), then it makes more sense that your mother misses you and just wants to come for a visit to see you.

This is all just speculation, a lot depends on the visa officer looking at the application. One visa officer may approve, and another reject, an identical application - it's up to their judgement.

What documents did your mom submit.... particularly those that demonstrate her ties to her home country?

Such as property or land ownership, employment or business, financial situation, dependent family (for example, your siblings or grandparents), previous travel history, etc?

Did she prove that she must return home by an XX date?

For how long did your mom intend to visit?


Please do NOT reapply with the exact same documents and evidence. A covering letter is fine. However, what counts is evidence

Considering your suggestions, I am trying to reformat entire covering letter and adding some more proofs that shows tie up with country of residence.

She had visited USA several times and returned back, so I thought, Visa officer must be seeing this very clearly that, she is not intending to stay in any country then india.

Any advice on same ?

Your help and suggestions are much appreciated ... !

Hi,

If she has visited the US in the last 10 years then she can apply for a TRV under the CAN+ program.

For this, you must show the US entry/exit stamps in the last 10 years..... if you apply online/paper then this must be scanned and included as part of the TRV application. She must also demonstrate her strong ties to India (although fewer documentation is required under CAN+).

Also, do prepare an Explanation XX: My Travel History..... in this, table the visa details + entry/exit dates + purpose of each visit + scan the US visa/visas of other countries.... Also mention her US visits in the Covering Letter

She has visited USA --- 7 times, average of 6 months stay with every visits ...

Canada , she wants to visit for 4 months ..

hi there like you said in point 2... do you think they reject for that reason? my brother also put tourism on the form but his wife is in cAnada who is a pr there. are you sure it could be a reason for rejection and for your information my brother was rejected only for 1 reason and it's

---- Hi, Thank you so much for your detailed advice. Point 2 -- I put "Family visit". So, I wonder.. what may be the reason there ! I didn't select tourism.

Hi Pranav,

I'm assuming your mom has visited/remained in the US 7 times in the last 10 years.... with an average of 6 months per visit. Unfortunately, this indicates weak ties to India..... and it means that she will stay long-term in Canada too.


What I suggest is:
1. Do NOT prepare the Explanation XX: My Travel History..... unless your mom has visited other countries (not just the US) on really short visits of a few days/weeks max.

2. Keep her Canada visit to just 2-3 weeks max. Not for 4 months

3. Draw up a detailed day-by-day itinerary of tourist places/activities/relatives and friends she would like to visit

4. Provide evidence that she must leave Canada after her 2-3 weeks visit.... for example, to visit the US and/or fly back to India from the US.... or visit/travel to a third country after her Canada visit

5. What strong ties can she show to India? Does she have any reason to return by a specific date?
