Visitor Visa or family sponsorship to bring wife in Canada ??

Hi,

I am a Permanent Resident in Canada. I am planning to get married next year mid. I have heard that the Spouse PR takes more than a year to complete. Is there a way I can bring my wife early for some months (for 4 to 6 months) after marriage on a visitor VISA ? Then, while she is on a visitor VISA, I will apply for her spouse PR application.

Is it possible ? If not is there any other way to bring her early on a temporary basis while her PR application is in process. Please provide some suggestions. She is currently doing a job in India.

Your wife can certainly try applying for a visitors visa. It does tend to be difficult to obtain a visitor visa once you are married to a Canadian (since CIC often suspects you may have plans to remain in Canada long term) - however your wife can certainly give it a try. If she is able to obtain a visitor visa then she can come to Canada and you can sponsor her while she is here.

If the visitor visa is not approved, your wife can try applying for a work permit (She will first need to secure a full time job offer from a Canadian employer and an approved LMIA). She can also try applying for a study permit - although study permits can also be refused if CIC suspects someone has plans to remain in Canada long term.

Note that in order to sponsor your wife for PR you must be living in Canada when the application is filed and must continue living in Canada while the application is being processed.

If your wife is from a non-visa exempt country, many people on here would probably say not to bother with a visitor visa application. Now it does depend on her status, does she have a great job, $$$ at home? If so, it is more likely they will not see her overstaying. If however you do apply, and do get refused, it may delay the process in the future for PR as your spouse. Also, if you do apply for a visitor visa and get refused, DO NOT apply for a student or work permit, etc etc etc. Once you have a refusal, that is all that is needed to refuse you again, so don't waste your time or money.

Putting together your application is a long and difficult process, you can start now, get everything together that you can, so when you do tie the knot, it's ready to go. Many people spend 2-6 months on getting the paperwork together. Plan well in advance, get translations and notarizations done when you are together, and have her sign forms. That way you have them in your possession and don't need to mail them back and forth.

Are we eligible to apply for a Dependent VISA for my wife (myself being a PR) ?

I heard that the Spouse of a Permanent Resident cannot apply for a Dependent VISA. Is it a correct information ?

No - you're not eligible. This visa is for spouses of foreign workers and international students only.

I am a little bit worried because I applied for visitor visa 4 weeks ago and I inclued the letter from my husband who is Canadien and it says that we are beginning the process for PR spousal sponsorship. I had the visitor visa the last year but it expired due to my passport expired. I got married this year and send the application again. Someone told me that they don't use to deliver the visitor visa in these cases when you are applying for PR. I am just starting to collect all documents and evidences but anyway it is indicated in the letter.

Any information? I don't what to do if the visitor visa is refused. I have not seen my husband for 5 months

If the employer offers that option, then it is possible. It is up to them to deal with the paperwork on that, did they say that is an option for her or are you just speculating?
It is possible for intra-company transferees to be exempt from the LMIA process, but that all depends on her skills and the employer.

I know about that employer that they process ICT (closed work permit) for their resources for international assignment. So, if she can get such an assignment, they will for sure process her ICT.

But what I needed to know if she can come to Canada with the ICT but with her marital status changed since we are getting married this November. Then I can apply for her Spousal Sponsorship ... Will there be any obligation during her Port Of Entry ?

I have also found the following clause saying "Dual Intent" in CIC portal. But it says that about Spousal Sponsorship first and work permit as second activity.

But question is about the reverse order... Work Permit first and then Spousal Sponsorship. Is it possible ?
