Visitor Extension followed by Common-Law - Medical question

Hello all,

My girlfriend and I are in Canada, living together for the past 10 months. We came last August, then went back to her home country for 1 month and then came back in January of this year.

I'm Canadian and we recently applied for her visitor visa extension so we could reach common-law status in 2 months. Now she just received a request for medical on her visitor extension application, with 30 days to submit.

My question is, can the same medical report be used when we go to apply as common-law in August? The form they sent me to submit for medical contains a specific number which I believe must be linked to the visitor extension app. Will they give me a physical report that I can later use to apply to Common-law in August?

It would be terrible having to pay for another medical in such short time and have to undergo x-rays again.

Hi

Yes, you should be able to use the same medical for the sponsorship app. The Panel Physician will give you a receipt and it will have the medical number on it.

Note that medicals expire after one year. If the PR app is still being processed, CIC may either extend the medical or request a new one.

We were going to do an INLAND app and I see there is a 16 month wait time for the first part: assessment of sponsor.

Does that mean they probably won't accept the medical, even though it is submitted in time?

Is there anything we can do to speed up the first process, or do I have to wait till we reach common law status to apply?

I believe that those can be obtained through an Access to Information or Privacy Act request, but I do not otherwise know the details.

Inland applications are supposed to wait for CIC to request a medical examination, although many submit one upfront anyway. Outland applications require an upfront medical exam.

Is there some particular reason you wish to apply inland? Aside from the faster work permit, processing times for inland applications are longer than almost all outland applications. Inland applications are also considered abandoned if you do not continually live in Canada aside from very short trips -- movements like "back to her home country for one month" could trigger this if done within the two years of processing.

Thank you very much for this information. I am running a business in Canada, and the Work Permit for her would be the reason for doing it inland. We spoke with an immigration lawyer who mentioned the work permits usually come out fast within 6 months on the inland app. Has that been your experience or what you've seen as well?

The doctor will notify you if they find something that needs further investigation or treatment but otherwise, you don't see any of the results.

From previous posts, your partner is Brazilian. Sao Paulo has an 80% posted processing time of 5 months, currently the FASTEST VO in the world, so WHY ON EARTH would you be applying inland where it takes 26 months?!?!


If you go inland, the medical she has to do now will be FAR out of date and she will most definitely have to have another one done. There is absolutely no way to speed up the process; you will have to wait in line for 26 months just like everyone else. You cannot apply before you are common-law unless you get married.

But if we apply from outland, can she still stay here in Canada and wait for the extension on her visitor visa?

Otherwise, if she has to go back to Brazil we will be separated and technically not be living together anymore to qualify as common-law. Won't it look bad having to explain this to immigration?

Medicals are usually good for one year. As long as the date on the medicals is less than one year from the date that you are sending them in, you should be okay.

It is perfectly fine to apply outland while in Canada. She doesn't have to return to Brazil.

I don't know what's up with that, is it usual for a visitor extention to have to get a medical? Was there some kind of red flag? Almost makes me think it was a mistake. My spouse had like 8 extensions and were never asked for a medical but is from US so that may be why.

But, I agree 150% do an outland app, if you do it properly (make sure there are no outdated forms, follow instructions to the letter, etc) you will get her full PR possibly faster or as fast as she'd get an inland work permit. The Brazil outland comes faster than even the US ones!

The extension was granted contingent upon the medical being completed; it will be revoked if the medical is not received by the deadline. Get it done ASAP.

Her Visitor Record arrived in the mail with the 6-month extension granted, but requesting the Medical Exam within 30 days like you said.

It also states at the bottom that the document is not valid for Re-entry.

Does that mean we cannot go even for a day trip to the US when we are in Niagara Falls?

It means that it does not guarantee entry into Canada. It is standard on all permits.
