visiting visa or Open work permit forr Spouse

Hi,

I am from India and currently on a Post Graduate work permit which is Valid till Feb 2015. I am working in Canada in Skilled job NOC B type. I am getting married in Feb 2013 and would like to get my spouse along with me.

I am in dilemma regarding the type of Visa I have to apply for my Spouse and the success rate (Visitor Visa or Open work permit). To my understanding a Spouse of a PGWP holder is eligible for open work permit.

I went through different posts and suggestions for various options available for spouses like Apply for visitor visa and apply for Open work permit with in Canada or directly apply for Open work Permit from India along with TRV.

Can seniors in this forum suggest which would be the best way to get my spouse here. Pls let me know what kind of documentation is needed from my employer to apply Visa for my spouse.

Well, the best option would be apply for a TRV. If your wife is eligiable she can also apply for work permit.

These basically are your only two options.

With work permit she has better chance to reach Canada....

please tell the success rate of SOWP, bcaus my wif also in PGwork prmit and now workd as shift suprvisor in subway store , and it comes under skill level B category and am in india.

We got married last year and expecting baby soon.
I am looking to sponsor her for by inland application.
Now my concern is how i will extend her Visa, after going through post some people suggest me to apply for open work permit but she hold study permit now.
Can some one guide me in this regard.
So my Question is how i will extend her stay by open work permit with Sponsorship application or apply for study permit extention.
Any suggestion highly appreciated.

if you are applying inland, her open work permit will be included in the application package. She will not be able to work for about 9-10 months until she receives first stage approval (AIP), so there's really no way for her to switch from a study permit to an OWP and expect to be able to work immediately. What she can do is switch from a study permit to a visitor visa, and then 30 days before that expires, ask for a 6 or 12 month etension. Whether she's approved is dependant on CIC and where you wife is from. If she's here as a visitor, she will not be able to work legally, or go to school in a program that lasts more than 6 mo.

depending on where your wife is from, the application process may be faster with an outland application. She would still be able to apply to switch to a visitor visa and later an extension to stay during the application process. Again, it's dependant on where she's from. With an outland app, she has more flexibility in leaving Canada. For an inland app, if she leaves at all, she is in jeopardy of having her application cancelled.

since her study permit doesn't expire until Oct, then i'd suggest to get your application for PR submitted before that, and either have her apply for another study visa, or change her status to visitor so she can stay, then apply to extend the visitor visa when it's time. If the inland application is sent in soon, by Oct. she will be about half way through her stage one approval wait time.

So as per your suggestion you advice me to put up her PR application first and than go for her visit visa in Sep.
If i did this way so may be they said her application of PR under process we cannot issue her visitor visa.

i think it's safer to switch her to visitor status FIRST, and if that's approved, send in the inland app, THEN apply for an extension before her visitor status expires. For an inland app, she must remain in canada during the entire process, so she can't leave. I agree with an outland app, it will be difficult for her to get a visitor visa after the application is submitted. Again, whether CIC allows her to switch her status to visitor and eventually extend is up to them, so there's no guarantee. trying to switch her status to visitor first will let you know what route to take. If she is denied the change in status, unfortunately, she will need to go home and apply outland, or risk remaining in canada illegally to apply inland.

I would recommend reposting this question in the family sponsorship thread to see what seniors and others in the same position suggest. I am certainly no expert in inland applications!
