Visiting Canada after getting refused for work visa

Hello,

I stayed in Canada in 2012 for 7 months in a row (applied for online extension so no overstay).
After spending 7 months in Canada on a tourist visa (stamp) I drove down to the border in Alberta to apply for a work visa, had all the documents ready etc.

The immigration officer was clearly looking for any reason to not approve my visa, started asking many questions and eventually decided to refuse my request.
After that, he let me back into the country but allowed me to stay only 1 week and said "you must leave the country within a week, if not- police can arrest you" etc.
He also mentioned that I can try to apply again with my documents for the work permit in my home country.

I am not sure if this was a deportation, because he basically just let me back into the country freely.
However, on the day I left Canada the immigration officers escorted me from the office at the airport (before the passport control) all the way to the gate, then they left and I waited there by myself.

Ever since, I have changed the passport twice (first time renewal due to expiry and second time I lost it in Thailand).

Now, 7 years later, I would like to visit Canada with my girlfriend for about 10 days.
Given my past experience I am worried they might won't let me into the country.

So my question is- how likely am I to get refused when trying to enter Canada again as a tourist?

What is your citizenship?

Did the escorting immigration officers give you departure papers? There is no exit passport control in Canada, so why did you report to immigration officers in the airport on departure? Were you told to?

It sounds like you had a departure order.

Think there’s more to this story then what’s being told . On what basis were you applying for a work visa ? If you’re eligible to get a visa you get one , if you aren’t , you don’t . And from being at the airport I’ve seen the paperwork people are given to individuals told to leave the country . They are told to report to immigration prior to leaving , immigration takes them to the gate , and then after departure checks with the airline to ensure the person left .

Yeah. There is no exit passport control, so at the airport, why would someone voluntarily show up at the CBSA office and say "Hi! I'm leaving the country! Care to walk me to the gate?" unless they were explicitly told, by CBSA, to leave, and to report to the CBSA when leaving.

Pre-Assessed..
Even though there is no exit passport control for most people, I saw CBSA questioned travelers of my flight while I was walking on the gangway towards my plane outside the boarding gate. I saw them showing CBSA their passport and answering question raised by CBSA.

That's a random screen, which they do occasionally. It's a lot different from being escorted to the gate after check in

Hi, I was arrested for a misdemeanor/Simple assault case In US last year, and matter was dismissed with no conditions/fines or any probations. I am now planning to apply for a tourist visa to Canada. I answered yes to the documents and it requested for PCC/FBI identity document, which I applied and got it with a dismissed arrest record. Could you please advise, am I admissible to Canada ? Do I need any additional documents other than fbi and court disposition letter.

Appreciate your response.

1. Yes you are criminally admissible as the charge was dismissed.

Hi

1. Yes you are criminally admissible as the charge was dismissed.
Thank you, that’s a big relief. Could you please suggest if the above documents are enough to support the arrest & dismissal or will I need any additional documentation.

Also do I need to explain in detail about the case or can I just say ‘ I was arrested for the simple assault and the case was dismissed in the court’ as the fbi/ court disposition doesn’t talk more about the incident, it just states case is dismissed

1. The FBI printout is sufficient proof of dismissal.

Thank you so much for your time.

I am nervous on what to fill in 5257 document for Have you been arrested ?

I mentioned Yes, I was arrested for the simple assault case and the case was dismissed in the court.

Could you please suggest if this is fine, or should i shorten or extend the explanation.

Hi @PMM,

Could you also please help on this last question, on how to fill 5257 form for arrest, i mentioned it as "I was arrested for a Simple Assault case. The case was directly dismissed by the court, WITHOUT any conditions or fines or probation.", is this fine ?

Kindly help.
