Hi, Wonderfull people
Please kindly ignore my (CAPS locked username), thank you.
I find myself so lucky after spending thousands of canadian dollars on lawyers i finally came across this wonderfull website where people are helping other people and sharing their experiences.
I am married to a wonderful beautiful creation of GOD (my wife that is) and we have two boys together. I want to apply for their Canadian Citizenship certificate then for their passport as i was told by a lawyer who nicely charged me $500 and disappeared.
My wife and the boys 8 years old and 4 months old respectively reside in India.
I am trying to bring them over to Canada but i don't know where to start. PLEASE HELP ME.
I have wasted my hard earned dollars on people claiming to be Lawyers and immigration consultants. I am so done with them. : (
Any help would help me a lot guys i am depressed and on the brink of giving up. please help.
I was young and was duped by a friend into bringing his sister over from india. I agreed to help. Little did i know their intention.
The case was rejected by the immigration officers stating that they did not consider this as a legitimate marriage and the sponsorship was denied.
I never heard from anyone the girl or my so called friend or his family ever again!!!!
Now when i went to apply for my WIFE the lawyer told me to that i can never call her here since i already have a marriage in the system and even through that previous case was rejected and the girl never came to canada and neither did i hear from anyone from their side about any divorce or seperation or whatever.

Sorry, so you committed immigration fraud and you want help now about how to get away from it! :eek:

There are good and helping people on this forum. But I think what you really need is a good lawyer who can give you sound legal advice. Find a better one.

No, I liked the girl we use to chat i also visited their family in india. We had a ceremony, went on outing and picnics everything. But it was sad that as soon as the case was rejected i did not hear from any of her family members or her.

Are you a Canadian citizen or a PR?
I am assuming your marriage to your first wife was legal in India. In which case you should have gotten divorced from this wife before you got married again. The fact you never heard from her again after her PR application was refused shows that the marriage was not genuine, but you still needed to get divorced from her before you got married again, at least in order to sponsor your second wife to Canada.

Have you lived with your second wife for at least 12 consecutive months? If so, you could sponsor her as your common-law partner. I would suggest you start divorce proceedings from your first wife.

You cannot sponsor your second wife as your wife because you are still married to the first one in the eyes of Canadian law. The fact that the immigration officer decided that the relationship was not genuine does not mean that the marriage does not exist.

I don't know your circumstances, but if possible I would start divorce proceedings from the first wife, then go to live with your second wife for a year (if you have not already lived with her for a year). You can then sponsor her as your common-law partner.

I did not get a hold of the previous person or her party for a divorce so I eventually gave up looking for them. They were from Pune. I don't know how I can divorce that person if I don't know where on this planet they are living.

You need to stop referring to her as your wife, because she isn't. You are still married to your first spouse and have actually committed bigamy, which is illegal in Canada.

Really? A few seconds on Google would have told you how to do divorce someone in absentia in Canada.

You can get divorced from her in Canada. You should hire a family lawyer in Canada to help you.
In any case, since you are not yet divorced from her, you cannot sponsor your second wife because legally in Canada she is not your wife. You can sponsor her as your common-law partner. You will have to explain the situation carefully in the application, since the visa officer will wonder why you did not get divorced before marrying again. You could say that since your first wife ran off after being rejected for a PR, you thought the marriage was over and that she was taking care of the divorce.

Hope you're all doing well.

I applied for a PR through Spousal sponsorship in October 2016 through the London Office. I'm a Pakistani residing in the UAE. We haven't really had any progress on the application since the Sponsorship approval therefore I was thinking of applying for a visit visa. I understand the rejection rate is high but I'm thinking I'll try my luck!

I created an application through my GC key account and started gathering documents required. There was a questionnaire before I went to the page where I could upload my documents. One of the questions was if I had a medical exam within the last 12 months to which I said Yes. Now the problem is its asking me to upload the proof of medical given at the end of the examination. I sent mine along with my PR application and did not take a copy. I altered my answer to the medical exam question within the last 12 months to No and saved the questionnaire. The next page (where I had to upload docs) then did not have a requirement for proof of medical. I am hesitant to say no as I technically did have a medical exam in the last 12 months (on the 18th of June to be precise) but I definitely do not want to do another medical unless I'm asked for the PR application. Any similar experiences or any words of wisdom?

Appreciate all your help in advance!

omg you lied on the application for the visitor visa that is misrepresentation if ircc finds out you can get in trouble

Quite a situation :) But do not worry. Try to contact you physician where you passed your last medical exam, describe your situation and ask for a copy. It shouldn't be a problem to get it, all you need is some sort of paper that confirm your visit. After that do as you were doing before at CG key account.
There is no any misrepresentation cause you haven't submitted your document package yet. So, no worries.

No, I haven't lied. This is a questionnaire the answers of which can be altered until submission which I haven't done yet ofcourse.

Thanks ZhabaHulk :) I was thinking along the same lines. I actually have a receipt of the medical I did last year which clearly says Canada Visa perhaps I will attach that and mention in my letter of explanation if I have no luck with the physician. Appreciate your response!
