Visa to visit my wife and children, but visa got rejected....

I am applying for visitor visa, to visit my wife, my baby boy and my new born baby girl...... but i got rejected twice in my visa what should i do? I really missed them it has been months i did not see them, especially my baby girl born there 1 week ago.... hmmm... i was thinking about student visa to get me in the country to visit them. Any good suggestion??? Please help... TQ :'(

Felix Theophilus, I'm sorry for what is happening to you. It is difficult to give you advice without knowing the background story. Have you ever lived in Canada? Where did you get married? Is your wife Canadian citizen? Does she have a job in Canada? Did your wife Invitation Letter for you? There are so much we don't know about your situation, so no one knows what advice to give you. Every situation is different which makes every course of action different.

Also, some people on this forum wrote that after you get rejected for the second time, you can contact CIC and request the Officer's notes showing the specific reason they rejected your application. So perhaps that is something you can do right now.

To be approved for a study visa, you must first be accepted by a school in Canada. It's too late to apply for the September term - so you would be looking at January 2014. Additionally, you will have to show that you have sufficient funds to pay for your studies and living expenses. This means that you will need to show you have a bank account balance of around $25K to $30K. Last but not least, you will have to demonstrate that you have strong ties to you home country and have no plans on remaining in Canada long term. Given your entire family is here and you have aleady been refused twice for a tourist visa - I think it's going to be incredibly difficult for you to prove this. So I wouldn't bother with the study visa. I think it will be refused.

O-Guy = No so far i only when to Canada for 3 weeks that is 2 years ago to visit my sister, I got married in Malaysia, yup my wife she is a Canadian as well as my children, hmm she cant work right now coz she need to take care our babes...... but my father in law and my mom in law do work.. ??? wow TQ hmm....

Scylla = Well money is not a problem at all, yeah is true and my sister is a citizen over there too... :'( arghhh that suck man and i even have my own company in my own country :'( and... arghhh thats suck.....

I agree. Student visa in this case is mission impossible especially knowing they rejected you twice for visitor visa. And you should not have to resort to lying to get into the country. You have strong ties to Canada, your wife and child are here, so your best chance is telling the the truth which is you want to come to Canada to visit your wife and child. Of course there is much more to it than that (depending on the particulars of your situation).

Has your wife already applied to sponsor you for permanent residency?

Well the things is i have my own company in my country too.. so which mean i will have to travel back to my own country again, i told them everything i never lie or whatever and Oh man , and now i dont even know how to see my family. well Thanks man.. i am really appreciate it. :)


Yeah she did but they told her that she need a job to sponsor me and she need my signature. :(

Well i have a friend she married to a Thai guy, he is not even working in his own country, he got no financial and he got into Canada freaking easy like nobody business.......... down man

Felix Theophilus, your wife can easily mail the documents to you for your signature, just like I mail the documents to my wife who lives in Asia. That is not difficult.

If you have your own company and can submit financial proof showing you have company, funds, etc then I can't imagine why they would reject your visitor visa. Perhaps your wife can hire a Canadian immigration lawyer.

Coz my wife have no driving license and she have to take care of 2 babes... hmm Thanks bro

As said above, you are most likely being refused a temporary visa because your ties to Canada (Canadian wife and children) are MUCH stronger than your ties to your home country (company, property, etc). This makes you a high risk for overstaying your visa. An immigration lawyer can't change that and would simply be a waste of money.

In regards to sponsorship, it sounds like she was told incorrect information by an immigration consultant and that neither of you have even looked at the application or talked directly to CIC. Your wife doesn't need to have a job to be able to sponsor you. She has to be able to show that you guys won't need to go on welfare. This can be by showing her savings, your savings, your income, financial support from both or your families, etc.

Agreed - your wife does not need to have a job to sponsor you. Get rid of your consultant. He clearly has no idea what he's doing.

I'm sure CIC is not assuming everyone from a Muslim country is terrorist. I'm a proud Muslim Canadian and many of our Immigration employees are Muslim, so there is no discrimination here.
