Hi. Can someone help me? I'm here in Canada and my visa as a visitor will expire on March. We already sent our application for family sponsorship under spouse and open work permit in December 2017 but until now we haven't received acknowledgement receipt. I am now confuse if i have to apply for extension because the website says that it has to be at least 30 days to apply for extension to stay legal here. Thank you

I would recommend to apply. But check for others to comment.

If you are married to a Canadian citizen, you can extend your stay. You can stay till six months from the day you entered Canada. If you intend to stay longer, you should apply for extension after five months of your stay.

If your status expires before your OWP is processed (about 5 months from submitting it) your OWP will be denied. You need to be in legal status. Don't let your visitor status expire. Apply for an extension.

I believe You have implied status until the owp is approved. It takes 6-8 weeks on average to receive acknowledgement of receipt

The 30 days before expiry is a suggestion... It is not a mandatory timeline.

You can actually do it right up until the day your visa/record expires. Example; if it expires on the 20th, you can apply on the 19th. I have done this twice successfully.

Only a Canadian Citizen's spouse can extend the visa? not a PR's spouse?

The website recommends applying 30 days ahead of time. It does not state that you are required to apply 30 days ahead to "stay legal". You can apply up until your status actually expires.

If you haven't received the OWP a few days before your visitor status expires in March, apply for an extension. If your OWP arrives soon after, withdraw the visitor extension and you will likely get a refund.
