Hello all,

I entered to Canada as a visitor last december and I have submitted my PR application within Canada last month.
I'm wondering if visitor visa extension is needed for my case?

Thanks in advance.

did you send an application for an open work permit along with your PR application? if so, that's the only way you can have implied status. The OWP application gives you implied status until you receive the decision about that permit.

if you did not submit an OWP application, then you do NOT have implied status and must apply for an extension to maintain legal status in canada. Simply submitting a PR application does not mean you can stay in canada without keeping your status current.

The OWP can still be submitted, as long as it will be received by CIC before the OP's visitor status expires. This will still provide the Implied Status as a visitor until the OWP is issued and received by the OP.

The OP should make it clear that s/he has already submitted an Inland sponsorship application (perhaps including a copy of the receipt), since that alone is the qualifier for this type of OWP. The correct fee used to be $255 ($155 for the OWP + $100 `Holder' fee).

The part involving implied status is incorrect.. If you were on a visitor visa and you applied for an open work permit you will not be on implied status if your visitor visa laps.

Here are the regulations regarding implied status.

Although I also found this (Here http://laws-lois.justice.gc.ca/eng/regulations/SOR-2002-227/page-34.html#h-93):

Extension of period authorized for stay

(5) Subject to subsection (5.1), if a temporary resident has applied for an extension of the period authorized for their stay and a decision is not made on the application by the end of the period authorized for their stay, the period is extended until

(a) the day on which a decision is made, if the application is refused; or

(b) the end of the new period authorized for their stay, if the application is allowed.
But does applying for an OWP count as an extension? Or in order for implied status as a visitor the OP has to submit a visitor visa extension?

I think regarless the OP is not able to work until a decision on the OWP has been made. (If an OWP application has been made)

Thanks all. I didn't and not planning to submit the open work permit.

If I wish to extend my stay here for one more year, is a medical exam will be needed?
(as the current processing time for PR is one year now)
