if the person being sponsored cannot extend study permit, then have to apply for change of status( as visitor visa)
should apply it before the study permit is expired or apply in 90 days after permit expired.

you find the following

"You can apply to sponsor your spouse, common-law or conjugal partner, or dependent children to immigrate to Canada. It does not matter if they live in or outside Canada. If they live in Canada, they do not need to have legal status to be sponsored."

What do they mean by "they do not need to have legal status to be sponsored".

that's the reason why I don't understand if my sponsored needs to request for another visa..

what do you think.

if your partner applied for inland sponsorship, then do not need to apply for any visa.
she/he can stay in Canada until receive PR.

if he/she applied for outland sponsorship, then need to apply for visa (extend study permit or visitor visa)


think that meant inland applicant- she/he is implied status until receive any result (approval or rejection)

I also ran into this paragraph before and it made no sense to me, even if you apply inland (the long process) those forms ask you to provide valid status as well. Unless it is overlooked by CIC and *not really* required during inland process, but they will still formally ask for it.

Are they applying INLAND or OUTLAND (and I don't mean living inside Canada, I mean which application version?).

If they applied outland, definitely apply to change conditions of their stay or to extend their visa before it expires.

If they applied inland, did they apply before their visa expired? If so they can apply for the OWP.

Yes my intention is to support him using the inland application, before his student visa expired. In this case as far as I understand
if his student visa expires, he doesn't need to request for student visa extension, am i right?

if he did apply for inland then no need to extend study permit : cannot study.
but if he did not apply for sponsorship yet, need to apply for inland before his permit expired.
then he can stay in Canada legally as implied status until he gets OWP and PR.

Looks like they have updated their Document Checklist for inland apps (IMM5443E)
now it says:

Indication of status in Canada (e.g. visitor visa, study permit or work permit, temporary resident permit, including out of status documentation
I remember last year that line required proof of valid status in Canada, and it made no sense. I guess it is safe to assume you can be completely out of status when applying inland.
