Visa Category for Dependant Wife: PMM please respond

Hi,

I have a quick question, I got Ph.D. admission with full scholarship for UWO Canada and am applying for a study permit. I have a wife and would like to apply for her visa at the same time. The embassy website says that she can apply for either worker, student or visitor category. So I duly filled up my and her study permit applications (Although admission letters and degrees were only attached for me as she is just a dependent) but the Visatronix guys are saying that she can only apply as a visitor? Is that correct?

In addition I have unfortunately also paid the amount for two study permits at the Standard Chartered? So I guess my question is does she apply as visitor or on study-permit plus can I get my amount at Standard Chartered refunded/changed to different visa category.

If your wife also get LOA from any university in Canada, only then she can apply for student visa. otherwise I guess the visa officer is right that she need to apply as a visitor or worker. But on that case visitor is more preferable, because for working category visa you need to have an arranged work for her in Canada, and should also got the appointment letter.
Actually I am also applying with my husband on dependent category, but I am afraid that is it a good idea that a student have a dependent with him?? So, I am afraid of applying as a dependent. If you know anything about the possibility of getting visa on that category plz let me know......

I think one can apply as dependent as long as the funding is there.

You are talking more about CIC Website rules but not how they treat South Asian applicants.

Its not so easy to get dependent alongwith on a student visa. I am not saying its impossible but its extremely hard to convince Visa Officer of your intention to return back to your country along with your dependent.

Even on this forum we have many examples where spouse get refused for a Open Work Permit on the basis of partner's student visa.

Refer to CHC Pakistan rules as applicable to your case. Do not go by Visatronix guy statement. In that end you must have some proof on the basis of which you put off your application.

You should have applied for an Open Work Permit along with her TRV and you study permit and TRV. As she didn't have an LOA, it was sort of pointless to apply for a study permit for her. You could have just applied for a TRV for her and then the OWP at the Port of Entry. So I guess that you will have to wait to see what the process visa office does.

Chances are low, but never NULL. So don't worry. You have to apply for your spouse as Visitor from here as PMM Mentioned. As Far your fee at Standard Chartered is concerned. I think if you have over-paid it, the Visa Office will auto adjust or refunds the remaining amount (I Guess it, not clear..)..

Actually I would rate the OP's chance a lot higher. He has a full scholarship to a PHD program at recognized school. He isn't taking an ACCA course in a private school.
