Dear Friends,

I am new to this Forum, I am MBA Graduate from India and have 6 years of Banking experience at Management level in India. Last year, One of my friend from Canada sponsored my Visitor visa for 10 years. and I came to Canada in June this year on Visitor visa citing Medical reasons at my job in India. Currently I am living in Calgary but because of employment pressure and time limit, I had to resign from my job in India and I am looking for options to stay here in Canada and possibly find employment so that I can get work permit and migrate here.

I have met few people and lawyers here in Calgary, and as per one of them, I can not find LMIA or employment option here in Canada, even I am willing to pay here but still finding it hard to get advise and feeling so stressful.

I have my parents, wife and one year kid back home and they are very worried about my situation here. Since, I have loan on my house back home and I resigned from my job as well, I am immensely feeling pressure right now.

Shall I move to different province ? Do I have any options ?

My humble request, if people on this forum can share their views and knowledge, I would really appreciate and thankful. Any information would be great great help at this time.

Thank you
Regards,

Naitik

Hi Naitik,

I'm very sorry to hear that you are in such situation. First of all why you can't find any employment option? Secondly I didn't even know that a friend can sponsor his friend, was that easy process?

I don't see a easy remedy to this or a short cut to stay in Canada. I would suggest you go back to India and get another job and make the things working for you and your family first. Immigration is always a secondary thing which requires a lot of time. After you go back search for all options in other countries too. Find out the appropriate Immigration according to you. Good luck.

Please don't find illegal ways to reside in a country like Canada. You may lose the opportunity for future.

Why would you quit your job? And not go back after your stay in Canada?

i believe you are on an non-immigrant visa so you cannot work. Getting a job would be difficult because you do not have a work permit. Paying for LMIA is unethical and something i would not advocate for. Look for means to get into the country legally.

My recommendation for you would be to go back to India, get a job and while you are working, apply for express entry. If you meet the points required to get an invite, great.. if not, apply for PNP. Go through the process we all have/ are going going through to get PR. The EE system imo is great and if you are qualified which i think you are, you should get through (PNP or directly through EE)

Go through it the right way and in 12 - 18 months, you will have a PR along with your family. That should give you enough time to wrap up your affairs in India and get ready to move your family to Canada

Alternatively, you can also apply to school in Canada, although that would be an expensive affair.

Dear Softdave,

Thank you so much for your post and concern. Yes, One of my friend who is settled in Canada, helped me to get visitor visa last year. He provided me invitation letter along with other documents to process my visitor visa.

Since, I am on Visitor visa for 10 years and allowed to stay here for 6 months on visit. I am not legally allowed to work here. Even though i have education and good work experience, but without work permit / work visa, Options are very tough for me.

Best Regards,

This is the reality. Anyone else who tells you you have a chance to get an LMIA only wants to get your money. Unless you have a very specialized set of skills or you are in a niche industry, no Canadian employer will give you employment or LMIA while you are on a TRV without a work permit.

The visitor visa and status is a privilege, not a right. If you make too many frequent and long visits to Canada on a visitor visa, even if it is valid for 10 years, you will have growing trouble each time you face the immigration officer and may even be denied entry.

@Naitik, you must go back to India immediately because you are increasing your own burden of Loan and Interest. you did a blunder by going on a visitor visa spending so much and you will make even a bigger blunder by not going back soon to your family.

So looks like you're on Visitor Visa right now. Only option for you is to get LMIA in order to qualify for Work permit but depends on the Visa officers at border which most likely will be very hard to convince them since you're on VISITORS. Other option is to apply for student visa then get PGWP but you can only work 20hrs/week during studies.

It was your personal decision to resign so don't blame Canada for that. You came as a visitor only, so you should go back and look for other options, as you already said your family needs you.

On one side, you said you are ready to pay here and other side you are saying you have loan to pay. So, I'm confused about your Financial situation. If you do you have enough finances you might qualify for Investors visa.

Moving to other provinces will not help you at all.

Your friend sponsored you. So, don't get him in trouble by overstaying or working illegally. He trusted you.

You might qualify for Express Entry FSW/PNP

Not a good idea to come here on visitor visa and try to settle. Even if you lucky to find an employer who is willing to go through LMIA process for you (you need to be really very-very lucky to find such employer in a very short time), the process for LMIA itself may take several months with no guaranty for success + few months WP application. Go home to your family, it's not worth it.

Dear amodmallya,

Thank you for your inputs, Could you please share your views on how do I look for PNP / EE Options ? I have no idea about EE but i have heard about PNP Option.

Are there any other possibilities such as PNP Route option or any thing similar I can look for while my stay here in Canada on visitor ?
Since, I have no job back home, home loan and especially having one year kid, i am feeling very stressed.

I have no intention to stay illegally or work illegally here in Canada, I am just trying out my fortune and attempts.

Thank you for information.

The fact that you are in Canada on visitor visa won't help you gain any permanent status. There are no privileges for visitors. Go home, take a deep breath, relax, clean your mind and then explore all possible immigration options.
