Valid LMO refused Working Visa for Canada

hi there!
my sister got a positive LMO from Canada and applied for Working visa and got the reply the other day - she got refused. on the grounds that she didnt satisfy the Visa officer of her economic ties and intentions to go back to her home country after the contract. it seems so unfair! i dont know what to do to help her now?

If she can show stronger economic ties and provide stronger proof that she will return home afterwards, then she can try applying again.

That's really her only option.

If you are in Canada, apply GCMS notes for your sister under the Access to Information Act in Canada. You will find VO's details explanation of refusal on that notes. It would cost you only $5. After that, she should rectify the reasons and reapply if she wants.

Yes, she can re-apply but the outcome would be same unless your sister rectifies the reasons for refusal of her application. What is the position?

I know a person who applied for work permit twice with the same LMO and got refuse both time.

1st time - You didn't satisfy VO that you would leave Canada .......blah blah blah.
2nd time - Your situation didn't change from the last .......blah blah blah.

i once applied for visitor visa 12 years ago and was denied for the same reason despite having all the back-up for my work and finances. so it's difficult to accept that reasoning!

my sister have a contract for kitchen helper (our close friend own a restaurant and offered her LMO) but she maybe over qualified too. Prior to this though 5 years ago she applied for Visitor visa but was denied.

i dont know it's difficult to understand how the VO's think but its just not fair. to think- they allow spouses/kids of contract workers to come on Open visa in canada to visit their wives/husbands which then have enough reason to stay for good.

one thing too why would they send you for medical then refuse you anyway? my sister submitted application Aug 10- and got all her documents back Oct 29th. amzingly fast but devastating result!

Yes you can never determine what the VO is thinking when the application is being evaluated. But she is not alone, searching for other posts in the forum will show that there have been a number of those refused despite having a valid LMO, and offer of employment and all the requisite requirements.

The GCMS notes will show the reasons for refusal - look as that before you decide if you want the assistance of an immigration lawyer. Perhaps the refusal grounds can still be corrected before you apply again.

for sure. i will access that when i get home. my sister also sent me a copy of the her documents from the embassy.

i am just waiting for the result of the other person on the lmo and she should have her her result within this week too. i will be mad if she gets approved because i did all the leg work and all and she is just an extension to back up the LMO request but then it's not her fault. right? i guess, atleast i have help someone who desperately needs change in her life. but it would be difficult for me to accept!!

i really dont know what to do after this one.... but would definitely look into other possibilities. told her to go check and enroll for IELTS/ESL/ TESOL - while we are looking for other venues...

If you want to apply for GCMS notes, apply ASAP. It usually takes 4 to 5 weeks to receive the notes. Otherwise, the LMO will be expired and your sister wouldn't be able to re-apply.
