Thanks, Parker! This is really useful information. You may or may not know the answer to this, but here goes:
We married in 2012, and for the rest of 2012, my husband has lived in the U.S. He will be coming up to Canada to wait out the rest of the PR process in Canada in February. I'm assuming he would only need this form for the 2013 tax year and not for 2012. Any ideas?

He will need it for both, as you're married.

And Kiri, you file both, but you more than likely will not owe the US money at all. I don't even know WHY they want to know what you make in another country, it's stupid really. But still have to file.

Okay. And yes, very stupid :p I think they are just being nosy, that's all. haha Well, I won't complain if I'm allowed the privilege of having PR.

I have another question that's been on my mind... anyone know this one:

Once I get PR and we progress on having a child... does that make my child automatically dual citizen of both Canada and US, or only Canadian citizen even though I'm a US citizen? If it doesn't, how do I give my child that opportunity.

US Citizens are responsible for paying US taxes on their worldwide income, regardless of their country of residence. There are other obligations as well, such as the FBAR form that you may be required to file.

There are lots of interesting wrinkles. For most people it just means a lot of paperwork, but generally doesn't involve much money.

I've told my spouse that I'm not signing the Lotto Max ticket if we ever win. I'd have to pay the US tax on it if it's mine, but a Canadian won't. Funny thing is that since we're married, it's half mine anyway. :D

In general it would make your child a dual citizen (there are lots of rules and oddball exceptions, but in general this is quite common).

Note that if your child is a US citizen, she or he must use her/his US passport whenever entering the US.

Sounds like hiring a tax consultant in Canada that knows the American stuff is in order. I'm sure there is one in southern Ontario.

Have any references I can look at? Soon as I get PR we're looking at starting on our family. Also you mean I'll have to apply for both a Canadian and US passport for them?

Sounds like this form is needed if we file jointly. I think we will just have him file as 'married but filing separately' so he doesn't need my tax information, if I understand correctly.

We just had this discussion about our Lotto Max ticket tonight. My husband claims it's his. I offered to read him our wedding vows out loud :p

It maybe procedural but you won't owe the goverment anything especially if you maintained residence outside USA residence. I have been a tax filer since the year 2000 and I have not seen such case arise. However, going by what happens when a person works in one state while residing in another that depends on if the wto states have a reciprical agreement, then they don't have to owe anything.

Thought I'd share our landing story, Mr. Parker24 landed today :)

It was nerve wracking. We landed at the Ogdensburg/Prescott Bridge, little tiny thing! Went through to the US Customs, he asked the citizenship of everyone (it was myself, my mother and hubby) and my mom, the driver, told him. The customs agent asked "How do you know him?" (my husband, to my mother) "Well he's my son-in-law" Agent: Oh that's too bad. Me: :-X Mom: For him maybe! Agent: For someone it is yes! :) I was freaking out when he said that haha. We did a U-turn, back OVER the bridge, to Canadian side, got up to the Agent, asked what our business was in the US, mom said hubby was landing as a PR. Apparently this agent was having an influx of immigrants, he seemed annoyed that he had to fill out more paperwork LOL. Asked us about tobacco, firearms and drugs, naturally. Then gave us back our passports, and a yellow slip to take in to the building. I'll take a moment and note, I'm a very excitable person, my husband isn't haha. I was practically jumping while walking in until I got glared at by agents inside! MEEP! So we go up, they tell us to sit down ::) ... We wait like 5 minutes and then the officer called us up, all three of us. Asked for hubby's COPR and asked what his status was in Canada. He says visitor. "Do you have it with you?" "Uh..no.. We applied for an extension at the beginning of November, but haven't heard anything yet" "Do you have the proof of that?" Him and me: :eek: Nope. She must have found it, asked for my mom and my passports to make sure we were Canadian and sent us to sit down. I attempted to read her lips hahah! But all I got was sign here, the card etc. So hubby explained afterwards that she had him go over everything and makes sure it was all right, told him about importing the car (we can just show up at that bridge with the title), talked about him getting a SIN and his PR card. Told him to NEVER lose the COPR, he'll need it like his birth certificate and marriage certificate, needs to be in a safe spot after he gets PR card. She stapled one of the pages of the COPR to his passport and said Congratulations! He was 5 feet from us so when he turned around we got up, went outside and I started getting bouncy again ;D Then drove back to Canada! Straight to Service Canada, got a SIN (took 15-20 minutes) and then to Service Ontario to ask about OHIP. You can apply before the three months, but you still have to wait three months. And said that he would need his Ontario DL, his PR card and a bill with his Canadian Address on it to get a health card.

And that's that! We're waiting on the title in the mail, will get a letter Recall Clearance from GM for the RIV, fix his dang door handle (it broke off last winter with all the ice) shop for insurance, GET insurance then import the car, get it safety check, e-tested and registered annnd get a DL of course.. Oh yeah and a job! :p

Then in three years citizenship ???

Did you call the IRS to ask? I may have to do that.

Someone on that thread (StateofConfusion) said,
'I actually called the IRS and asked them how I should file since my husband is a nonresident alien (Canadian) and doesn't have a social security number or an ITIN. And since he didn't meet the presence law (being in the US for 180 days or more) and we plan to file "Married but filing separately", my spouse doesn't need an ITIN or a ss#. They told me I would have to file by mail, and in the section for my husband on the 1040 form I just need to write "nonresident alien". Seems simple enough. Granted you aren't entitled to some credits you would be if you file "Married filing jointly".'

As many others have noted, U.S. citizens have a continuing obligation to file U.S. tax returns (not necessarily pay taxes) regardless of where they live/reside. Here's a link to a 2012-2013 tax planning guide prepared by an accounting firm which appears to be knowledgeable about both Canadian and U.S. taxes (see page 38). haha no, the personal choice comment was regarding my marital status since filing as single or married (but not filing jointly) wouldn't make much difference to my tax returns. I am not planning to ignore my taxes lol
