Seeking clarification on how long I can stay in the USA with my spouse while we await CIC decision for her PR status in Canada. I''m aware of the IRS 183-day formula over a period of 3 years. Do we make the calculation by calendar year, or by counting 3 years back in time from today's date? Do I have to count every day I spent an hour shopping in the USA as a full day? (My home in Canada is right on the border, and I have a US mailbox address.) I had planned to stay for a total of 5 months from last Nov. until the end of March, but plan to return to help pack for our cross-continent drive with all her belongings and our pets. I don't want to trigger the possibility of US border control denying me entry for the next 10 years if I exceed the length of stay limits. Thanks for any help clarifying my confusion.

Lol what part of Virginia, I live in VA .... ;D

Does anyone have US clients that they continue to serve after they move back to Canada?

I'm assuming my US green card will be void once I move back with my husband.
So do I claim the income to US or Canada?

Your US green card is not void. But you can lose it if you stay too many days outside the USA. I'm not sure what the residency obligations are for a US greencard. I think it is 183 days out of a year?

You need to file taxes to both countries unless you renounce your greencard ASAP. Canada will get first crack at your income and you can get credits for the taxes paid to Canada to use for your US taxes. There are a lot of caveats here and it is really complex so I recommend you talk to a cross-border tax professional.

Hey everyone,
So I filed an application to sponsor my husband on June 16, 2014. Got sponsorship approval on August 8, and the file was transferred to Ottawa on August 20th.

On October 10, I received an email asking for financial documents to prove I could support my husband since I receive social assistance for a disability. We provided proof of savings, tax returns, and a job letter to show that he has a job lined up for when he moves here. They gave us until November 25 to send these documents but we sent them way before and Canada Post tracking shows they were received October 29.

Since then we have heard nothing. ECAS still says application received. I emailed them December 5th and didn't hear back so my husband emailed them January 5th and still nothing. I know they have 20 business days to respond so we will until next week before emailing them again although I am not sure it's accomplishing anything.

In the meantime he's gotten the visitor record paper thing for his passport so he can stay here for longer periods. He can't work though so we are at the point where he's gotta go back to the US and lease an apartment again or something. We don't know what to do. We didn't think it would take longer than 6 months as others who applied around the same time and had documents requested have already received COPR.

His FBI criminal record check was done March last year and medical April last year. Will those expire? I appreciate any insights or advice you guys can offer.

We are also in that anxious waiting period I was approved as sponsor on September 8th and our file also sent to Ottawa. They didn't request anything further so I thought we would have heard something by now. Best advice I received a as to call super early in the morning and call back until I was in line for a call. Stay on hold and then state your concerned about paperwork being lost it does happen. First when I was approved as a sponsor I didn't find out until December because of wrong email I listed. I had no idea until I called and looked over my own paperwork again.

Not sure this is tons of help but I do believe it's possible you ended up on the bottom of someone's pile again as you had to re submit docs. Just a guess and you could hear something any day! Good luck I hope it's soon!

Hm, I had no idea you could call CPC Ottawa. They said fax and email only. What is the number?

Oh no, mis-understood. I called the Case Processing Centre. I never tried to call Ottawa before. I thought if you called where you sent the paperwork first, they might help you by looking it up on their computer.

Yes. I have U.S. clients whose U.S. dollars I will gladly accept into my Canadian bank account at today's exchange rate. I also have overseas clients who pay me in U.S. dollars. Oh, and even my Canadian clients pay me in U.S. dollars.

Yes the US almighty dollar is looks better & better! I wonder how long the price of oil will stay down?

Q1: Do you provide us clients with a W9? If not, do you have troubles securing US clients without it? Or are they happy to pay international contractors?

Q2: Do you have a cross border accountant? Or do you do your own taxes?

are you the one applying for pr or are you sponsoring your family to become pr? if you are the one applying through a program that's not family sponsorship, then cic will make a decision based on your residency/citizenship. if your family is applying for pr and you are sponsoring them, it will be based on their residency alone, and your residency will have no impact of where it is processed. no one can tell you for sure where your applicaiton will be processed since the decision is for cic to make.
