Since his son's Mother retains full custody, your husband can add his son to his application as a non-accompanying family member. His son will need to get a medical exam but will not get a PR visa. See 5.11 of OP-2Officers will not issue a permanent resident visa to separated spouses, common-law partners or children in the custody of someone else, even if they are examined . This is because separated spouses and partners are not members of the family class as per R117(9)(c) and because children in the custody of someone else are non-accompanying family members.
Yes. CIC will ask for documentation showing the shared custody. The child would also need to have a medical exam and his Mother would need to sign a letter that, as computergeek mentions, is very specific (incl. indicating she is OK with her son becoming a Canadian PR and that she realizes that does not confer upon her any rights to enter Canada.)figtoria said:Can they share custody and still have the boy move to Canada?

Did the office give you a sheet of paper with your picture, some identification information and a "UMI" number on it? If so, that's what you need to send. Ours had a section at the bottom saying "You have completed your health examinations prior to applying for a visa. It confused me as well because I kept looking for something that said IMM 1017 on it.
Most Immigration physicals are not up-front (they are based on a request from the VO). Outland spousal are up-front and the Panel Physician provides the paperwork - either the receipt with the unique IME # on it OR the EDE version of IMM 1017 (EDE = "Excessive Demand Exempt"). I know right! My wife got her PPR on Sept 25 and then on Nov 7 she got another email asking for immigration photos. We figured CIC lost the ones she had done at time of her medical and she had new ones done on Nov 7th and sent them by special delivery. Of course due to long weekend (remembrance day) it was after Nov 11 before they were received. So that has delayed our COPR getting here. Guess what she found in her wallet today? Yup tucked away in a little envelope for safe keeping the photos she had done last February! Somehow we forgot to include them when we couriered our application package in March.
