Hi all,

I am in the similar situation with kashish1728 regarding the rejected asylum petition in the US. I came to the US about 15 years ago because my father did an arrangement marriage to a guy in the US. My family and I did not know this guy was illegal. After my visitor visa expired for few months, I applied political asylum, but my petition got denied. Short story, I got divorced, and continued to appeal until the federal court. At the end, I gave up and became illegal. I wanted to change my life, so I attended a local community college, got my associate degree, & transferred to state university in pursuing undergraduate degree in Accounting. I will be graduated this December 2017 with GPA around 3.6/4.0

I wanted to continue to Master of Accounting (MACC) program to get my CPA license in the future. Actually, I've already been accepted into MACC program in my university next Fall 2018, but I realize my illegal status is my biggest obstacle to get an internship job and permanent job in firms or other companies. I don't have a future in the US because of my illegal status. I joined this forum to get more detailed informations about the path in applying a study permit in Canada for those who have similar situation like me & kashish1728. I want to study again in Canada to become a CPA, and hopefully to immigrate to Canada and contributing to their economy and society. My aunties from my father side are willing to help me for some of the tuition cost in Canada because they knew about my arrangement marriage in the past.

But my concern is I am worry that Canadian embassy would reject my study permit because of my history in the US. Do I need to go back to my home country, and apply a student visa from there? I have my passport, and I have sufficient money for about 1.5 years of tuition & living cost in Canada.

Another information, my brother is a permanent resident in Canada. He works as a software engineer in a small company in downtown Toronto. About my brother: He graduated from the US in Computer Science degree as an international student 17 years ago, & then became out-of-status. Short story, he applied political asylum, & got rejected. After worked in the US under the radar for years, he applied a permanent residence for Canada under Federal Skilled Worker program. He was lucky enough because his company at that time merger with a company in Toronto, & they sponsored him.

My situation is completely different than my brother since I came to the US with visitor visa while my brother came with a student visa (F-1). I need a kindly advice and perhaps some people can share their experiences or others' experience who have been in similar situation like me.

We've seen a number of people immigrate to Canada while illegally in the US on this forum. Provided the person is 100% honest about their immigration history and illegal status - being approved isn't a problem.

It's mandatory to obtain an FBI certificate. Without an FBI certificate, the Canadian application will be refused 100%.

The application cannot be completed without a valid passport. If the applicant cannot renew his/her passport from within the US, he/she will need to return home and do it from there.

I read about the Canadian Express Entry but don’t know if that’s a good option for my husband. I’m a US citizen still struggling with my husband’s illegal status in the US. I honestly rather move to Canada, but what other option to immigrate to Canada does he have?
What options you have to immigrate to Canada will depend on your occupation (i.e. skilled, semi-skilled or unskilled), work experience, education, what you're able to score on a language test, your age, whether you have a job offer in Canada and what funds you have to establish yourself in Canada. There is no special stream for Americans - you will need to apply and qualify just like anyone else. Canada has a number of different immigration programs and you'll need to spend time researching each to understand what is required to qualify and apply. i have been in USA as illegal for 8 yers and now my finance applying PR for me so it can affect my visa for CANADA ????
do i have to stay in my country for minimum 1 year? or i can apply in like 2-3 months ???

Your status in US does not matter for Canadian immigration.

just curious how can an illegal get FBI PCC???
Easy, FBI has nothing to do (in general) with ICE.

We did this (with a bit of hesitation) last year, obviously the scare part for my spouse was to go to the local police station to do fingerprinting, but nothing bad happened. Got my spouse's fingerprint card from police in 10 minutes and sent application with fee and card to FBI. Got FBI PCC back after normal waiting time.
