URGET HELP-Want to sponsor my spouse but her father had criminal case.

Hello all,

Please urgent help is required, soon I want to sponsor my spousal by next year and her father has made criminal offence, so does it affects on my future wife application or i have mention her father's background any where, please help me i am so tensed .

Because of her father, canadian immigration will reject my spousal application ? please confirm and expert advise required .

Her father's criminal case will have no impact on her sponsorship. You have nothing to worry about.

It won't affect your application.

The criminality check is for people included in the application being sponsored.

but do i have to mention her family background history anywhere , if yes, they gonna ask family criminal records because on background declaration form they gonna ask . can you please confirm


its really urgent and such questions are running in my mind all the time .

Should i apply through any big immigration lawyer ?

On the forms they ask if the applicant and any family members have been charged with a crime, and so on. However, for the forms, 'family member' means 'spouse, common-law or conjugal partner, and dependent children'. (For the Additional Family Information form, you do have to list the applicant's parents, however.) So your father-in-law is not included, and his criminal case does not have to be mentioned.

CIC will probably find out about the case when they do the background checks, but it should not make any difference to your wife's application. Unless it was terrorism-related, or organized crime, which might lead them to investigate your wife more than usual.

The background check for a spouse includes their immediate family as well?

It could. There was one case where the background check was taking a long time because of possible ties to terrorism. In this case it was a friend of the applicant who was suspected.

At my husband's appeal, the government lawyer knew where my sister worked - that is, they had information about the sister of the sponsor. I think they can look at anything they want in the background check.

Does CIC do background check for the applicant family members even though they are not included as defendants in the form.. There's a form that asks for additional family members, obviously u have to fill in their names there, does CIC do background check for the additional family members?

As far as I know, CIC can do background checks on friends, family, and associates. This doesn't mean they will. Probably in most cases they would just check that the information provided is correct, and maybe look at the person's job. It is just that if there is some issue, they can investigate further.

I know someone who used to do background checks for the military, and she said that they had a limit of how much they could spend doing the check (it was very high, I think $40,000, and this was years ago). Most of the time, they did not look at much - if things appeared normal, and everything checked out at first, they wouldn't go further. If the things they looked at first didn't check out, then they would investigate. I'm guessing the same procedure is followed in immigration cases.

Ok.. That is kind of strange.. I thought their concern should only be on the main sponsor and PA

i'd imagine they are going to want to check out the PA's close associates to see if anything out of the ordinary is there. i'm sure if any background checks are done on additional family members, it's very limited, and not .

Honestly.... Just apply youll never know the outcome unless you try it out. Let them do all the digging what matters most is that your wife didnt commit the crime Best of luck hopefully it all goes smoothly.

Seriously, READ the previous posts. Your wife's father's criminal issues will have ZERO impact on a sponsorship app; CIC does not punish people for the mistakes of others.

Your spouse is the Principal Applicant. "Family members" refers to spouse and dependent children of the PA that are not already Canadian citizens or PRs.
