i dont knw it this is up-to-date source but according to operational bulletin 193, you need to have both a valid study permit and OCWP to work during the transition period from OCWP to PGWP.
Did you have a valid study permit along with OCWP?

yep, i did.... they expeired at the same date....Aug 31st 2011

Hi, everyone, i have just got my GCMS note....
i think i am in trouble now. can anyone help me with that !
i finished all my course in School in 2010 Dec, then i went back to my country for 3month and came back to Canada in March 2011
i tried to apply my PGWP, but they refused me as i did not submit my transcript, then i re-submitted again in June 2011, when my graduating ceremony was, then i got my PGWP in 2011. i heard that i can use my off campus to work (Which is expeired in Aug 31 2011) while i am waiting for my PGWP.
BUT today, when i received the GCMs, it states in the note that i was found NON-COMPLIANT FOR FAILING TO SURRENDER ocwp after leaving School.
is it mostly likely a refused in my case? what can i do with it??? can anyone help??

I received my gcms notes since last week and everything is fine and I have passed eligibility and the notes also said: required work experience and education met. The officer said that he is satisfied with everything. I am only waiting for medical and wonders why it is taking long, though the due date is September 7th 2013 but not sure if I have to wait till this date. I am also on pgwp and recently received bowp. ur case is strange because as for me I never returned my off campus work permit. I studied full time for 2yrs and completed with same school. I never changed institution and I received my pgwp 3 months after graduation. I worked with off campus work permit but never count it towards my cec experience and it expired by the time I received my pgwp. I am still wondering about ur case and why it differs from mine.

did u at any chance drop out of school during ur study period?? or enrolled from full time to part time?? it could be the reason why they expected u to return the ocwp

My question is "what does "the completion of the program of study" consider as ???
does it consider as the date i got my cerificate or the date i finished my exam or the date i got my grade out ???
it is uncleared....if they do consider the date i finished all my course, then over 90days, which i should return my OCWP, why did they give PGWP at that time?? they can reject my pgwp.......
but they gave my PGWP, then they should consider the date of the completion of the program of study is the graduation date, which is in June, then i should have 90days to use my OCWP from June....and i got my pgwp on Aug 11.... then that mean i was still legally to work....

in that case, they might have considered it part time and u supposed to return the ocwp. I think u need to seek legal advice. u might as well go thru the link provided by the other member

Hi Nicole - to me it sounds like they've decided to "pass" you on this, so I second those who say, no point in worrying. But since you are wondering - your PGWP is not dependent on having an OCWP. Also, 2011 is when GCMS was just starting to go online, it was not so easy then for VOs to cross-check everything...

For the purpose of the OCWP program (which is not necessarily the same as CEC), the OCWP is supposed to be returned if you are no longer eligible to hold it, regardless of the expiration date. You said you completed your program Dec 2011, left Canada for 3 months, and returned for graduation. But did you register as full-time a student for Spring 2013? If not, then you had 3 months from December to return your OCWP or apply for the PGWP - sounds like maybe you waited too long to apply for the PGWP.

Transition from off-campus work permits to post-graduation work permits
Students can apply for a post-graduation work permit—a one-time opportunity—during the 90-
day transition period on completion of their academic program if they fulfil all of the requirements
for the PGWPP. Since the validity period of an off-campus work permit is usually the same as the
student's study period (the duration of the academic program plus 90 days), they do not have to
surrender their off-campus work permit to apply. They can continue to work under the off-campus
work permit provided that they hold both a valid study permit and a valid off-campus work permit.
Employment during this transition period can be full-time.

but u never worked illegally. The issue here is that u didn't return ur ocwp when u diverted to part time study. and since u passed the eligibility, the eligibility is no longer the issue as they have pointed out something else other than that so I still suggest u talk to a lawyer.

I don't actually see that you provided us the dates that you worked, and the date you applied - are you saying that between the time you returned to Canada and the time you got your PGWP, you were working, and expecting that experience to count towards your requirement?
